Minimum Qualifications Candidates must be a member of the bar and licensed to practice in New York State for a minimum of five (5) years. Preferred candidates will have at least five (5) years of legal experience in Medicaid law, Medicaid financing, health care financing, and/or managed care. Experience in mental health, health care, or disability law and HIPAA and other State and Federal health care confidentiality rules is preferred.

This is an exempt position; appointees serve at the pleasure of the appointing authority.

Duties Description The Office of Mental Health (OMH) is seeking a qualified candidate for the exempt position of Associate Counsel, NS, who will serve as the Deputy Counsel for Finance. The incumbent manages and directs the activities of the Bureau and supervises the attorneys assigned to the Bureau. Under the general direction of the Deputy Commissioner and Counsel, the Associate Counsel will provide legal advice and opinions to senior Agency leadership on issues related to Medicaid and Medicare financing. Specific duties to be performed include, but are not limited to, the following:

Provides legal advice on issues related to Medicaid and Medicare financing, including the following: implementation of Medicaid behavioral health managed care for children; implementation of Value-Based Payments; and Medicaid data sharing.

Provides legal advice in defending the agency in the defense of Medicaid and Medicare Audit Disallowances.

Assists in writing regulations pertaining to Medicaid providers and services.

Assists the Department of Health and other stakeholders in drafting and obtaining Federal approval of amendments to the State Medicaid Plan.

Provides legal advice in the development of financing strategies and proposes changes in Agency policy and practice that are consistent with relevant Federal and State laws.

Provides legal advice and opinions to senior Agency leadership related to State financing of local mental health services and activities and services of the Agency in the development of Agency policy.

Reviews Agency programs and considers proposals for change in Agency policy from a legal viewpoint and works collaboratively with senior leadership to assist in the constructive development of Agency policy in conformance with the requirements of law.

Plans, assigns, and supervises the work activities of subordinate line attorneys in the Bureau.

Perform other tasks as assigned by the General Counsel.
