Salary RangeFrom $99415 to $125629 Annually
Minimum Qualifications Eligible for a Section 52.6 transfer OR reachable on the Associate Attorney eligible list.
PREFERRED QUALIFICATIONS:
Excellent written and oral communication skills to succinctly and precisely summarize the law and the facts and to persuasively offer a recommended course of action to agency managers and program administrators.
The ability to understand the business decisions of agency program managers and the legal implications of those decisions and to find ways to balance legal risk with the operational needs of the Department.
A history of appropriately setting priorities, meeting deadlines, and demonstrating an awareness of how the work of a Counsel’s Office advances the strategic objectives of its agency.
Duties Description Under the supervision of General Counsel, Special Counsel, and Supervising Attorney duties will include, but are not limited to:
• Drafts, coordinates, comments, monitors and provides information on legislative proposals to the Department program administrators.
• Serves as the Agency’s Ethics Officer and advises on ethics related matters and provides liaison support with JCOPE.
• Oversees the Investigations Unit, providing day-to-day supervision of its ongoing operations and making determinations as to individual cases after application of the Correction Law Article 23A analysis.
• Assists legal staff in problem solving and formulating strategy for agency representation.
• Reviews draft documents to ensure that facts and arguments are presented as clearly and cogently as possible to protect State interests.
• Responsibility for conducting or overseeing the conduct of hearings, pursuant to civil service law and human rights law.
• Reviews proposed and enacted laws and rules of localities to ensure their compliance with State and federal laws, rules and regulations.
• Identifies opportunities to increase the experience and competency of attorneys handling litigation, investigative, employment and other matters.
• Ensures that agency policies are applied consistently.
• Conducts performance reviews and performs other supervisory responsibilities.
• Advises agency managers and program administrators on the effective implementation of civil service, labor, employment and retirement laws and regulations.
• Advises staff of other agencies regarding the implementation of civil service law and regulations, including, but not limited to, discipline, termination and probation matters.
• Advises agency managers and program administrators on the legality of current and proposed Department action and policy.
• Coordinates and undertakes the research of statutes, regulations, court decisions, and administrative opinions and rulings and, where necessary, oversees the preparation of written legal opinions to respond to inquiries from agency managers.
• Analyzes program requests for statutory and regulatory changes.
• Provides legal support to the Civil Service Commission including attending meetings, drafting legal memoranda and reviewing appeals.
• Analyzes the impact of judicial determinations and guides program managers in compliance with such determinations.
• May represent the Department in legal proceedings and/or serves as liaison with Office of the Attorney General, State Inspector General, Division of Human Rights (as the case may be) on complex or sensitive matters, and directs staff in drafting of affidavits, answers to complaints, and all other related litigation documents.
