Duties Description Primary Purpose
Under the direction of the General Counsel, a Managing General Counsel, or an Assistant General Counsel, and with a high degree of independent judgment and responsibility, renders legal advice and executes legal assignments with respect to labor and employment law issues at DASNY. Acts in a confidential capacity to the executive staff and the Board of Directors of DASNY on policy, personnel, internal and investigative matters, collective bargaining, and labor relations issues.

Essential Functions
• Renders legal advice on a wide range of labor and employment laws and regulations, including anti-discrimination, FMLA, Workers’ Compensation, ADA and other disability related laws.
• Represents DASNY, and/or coordinates with and directs outside counsel, including the Attorney General's Office, in connection with all aspects of labor and employment matters including administrative proceedings and litigation in which DASNY is involved, including discrimination, contract, employment tort and wage and hour cases.
• Prepares legislation; renders advice with respect to the formulation, coordination and execution of DASNY’s legislative program.
• Participates, on behalf of DASNY, in the collective bargaining process, including the development of proposals and the negotiation of collective bargaining agreements; interprets collective bargaining agreements both within and outside the grievance process; and provides legal advice to management concerning the application of federal, state and local employment laws.
• Participates in, and/or directs confidential internal investigations into allegations involving staff misconduct/corruption and recommends corrective action measures.
• Participates in, and/or directs confidential internal investigations into allegations involving harassment, discrimination and related retaliation and recommends corrective measures.
• Conducts interviews and interrogations with respect to labor and/or employment law matters; interviews witnesses, complainants and subjects of investigations.
• Prepares detailed reports of investigative findings and recommendations in relation to assigned cases.
• Participates in, and/or directs vulnerability assessments or integrity tests of policies, programs, and projects to identify susceptibility to mismanagement, fraud, and waste and recommends corrective strategies.

Other Duties and Responsibilities
• May supervise, train and evaluate employees.
• Handles disciplinary matters and handles all aspects of grievances, arbitration and disciplinary measures in accordance with applicable collective bargaining agreements.
• Participates in collective bargaining and other employee relation matters; administer and ensure adherence to applicable bargaining agreements.
• Develops, document and implement policies and procedures.
• Undertakes special assignments as directed.
• Must maintain regular attendance in accordance with DASNY attendance and leave policies.
• Must adhere to the NYS Information Security Policy Standards established and issued by the Office of Cyber Security and Critical Infrastructure Coordination. (Standards can be found on the Intranet).

Additional Comments Supervision
Supervision of employees may be required.

Physical/Mental/Visual Demands
Travel may be required, generally to the NYC area, using public transportation, DASNY vehicle, rental vehicle or personal vehicle. This travel may include overnight stays. Requires complex and time-pressured decision making. Must be able to work overtime or extended work hours as needed.
