Minimum Qualifications Candidates must be reachable on the appropriate Civil Service eligible list.

Transfer Qualifications:
Candidates must have one year of permanent competitive service as an Associate Attorney or Compensation Claims Referee. Also eligible to apply are candidates who possess the required credentials and who have at least one year of permanent competitive service in a title at the G-26 or above level designated as appropriate for transfer per Section 52.6 of the Civil Service Law.

Provisional Qualifications: In order to qualify for provisional appointment, candidates must have one year of permanent, competitive service as Senior Attorney, SG-25. Or five years of legal experience subsequent to admission to the Bar of any state in the US, which must have included one year of experience as follows: (A) in the practice of Workers Compensation Law, Volunteer Firefighters Benefit Law, Volunteer Ambulance Workers Benefits Law, personal injury law, or insurance claims laws; (B) or as a judge in a court of record; or as an administrative hearing official presiding over adversarial proceedings, arbitration, or fact finding within a private or public tribunal; (C) or combination of experience noted in A and B; and admission to the NYS Bar and being a member in good standing. If appointed provisionally, the incumbent will need to take the next Civil Service examination for this title and pass with a score that will be immediately reachable on the resulting eligible list. Failure to take, pass and achieve a reachable score on the examination may result in revocation of the appointment.

Duties Description Reviews informal administrative determinations and proposed conciliation decisions; reviews from an electronic file claims for Workers’ Compensation benefits which have been accepted by the carrier but which have various issues in dispute; attempts to resolve those issues with the parties through a proposed decision; conducts formal evidentiary hearings and rendering decisions on claims arising under the Workers’ Compensation Law, Disability Benefits Law, Voluntary Ambulance Workers’ Law; presides over discrimination hearings under the WCL and Paid Family Medical Leave Act; conducts hearings related to denials of medical treatments; and rules on legal objections to medical bills raised by carriers; may evaluate whether an Order of the Chair should be issued relative to requests for special medical services; travel to itinerant hearing locations within a district is necessary.
