Minimum Qualifications The ideal candidate will possess the following qualifications:
• At least 8 years of post-graduate legal experience, preferably with a focus on civil litigation and/or appellate advocacy;
• Demonstrated knowledge of workers’ compensation laws;
• Prior experience supervising attorneys and support staff is preferred;
• Superb legal analysis, legal writing and editing, and oral advocacy skills;
• Outstanding organizational, interpersonal communication, problem solving, and teamwork skills; and
• A demonstrated commitment to public service.
Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Office be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.
Duties Description The Labor Bureau of the New York State Office of the Attorney General (NYAG) is seeking an attorney to serve as the Workers’ Compensation Section Chief (Section Chief) in the New York City office. The Labor Bureau has been nationally recognized for aggressively enforcing labor standards, especially in low-wage industries where exploitation of workers is common. The Labor Bureau brings civil and criminal prosecutions for violations of minimum wage, overtime, prevailing wage, protections against discrimination and retaliation, and other critical labor and employment laws. Besides the AAG’s own affirmative investigations, the Labor Bureau also represents New York State agencies in their enforcement of labor laws, defensive litigation in state and federal court that often raises similar substantive issues in a different procedural setting.
The Workers’ Compensation Section represents the New York State Workers’ Compensation Board in certain cases and has approximately three (3) attorneys and one (1) civil service staff member, as well as access to additional support staff and attorneys.
The Section Chief’s responsibilities will include, but not be limited to:
• Supervising the Section’s attorneys and support staff, including reviewing and editing briefs to the Appellate Division and overseeing motions practice, Article 78 proceedings and federal court actions involving decisions made by the Board;
• Directly handling a caseload of workers’ compensation appeals and other matters;
• Maintaining a strong relationship with the NYS Workers’ Compensation Board;
• Developing investigations and civil prosecutions of employers for failure to obtain workers’ compensation insurance as required by law; and
• Ensuring appropriate professional development opportunities for the Section’s attorneys, including keeping them, as well as the Bureau Chief and Deputy Bureau Chief, apprised of the Section’s significant cases and developments in the Worker’s Compensation field.
