Minimum Qualifications MINIMUM QUALIFICATIONS:

Provisional Appointment: For non-permanent provisional appointment, candidates must have one year of permanent competitive or 55b/c service as an Associate Director, Human Resources 2 (Labor Relations) or Human Resources Specialist 3 (Labor Relations). Provisional candidates must take the examination for Associate Director, Human Resources 3 (Labor Relations) when it is next offered and must be reachable on the resulting eligible list to maintain employment.

Duties Description The New York State Education Department’s (NYSED) is seeking candidates for an Associate Director, Human Resources 3 (Labor Relations) position in the Office of Human Resources Management (OHRM). Under the direction of the Director, Human Resources Management 5, the incumbent of this position will plan, develop, and direct the Department’s labor relations program, with major responsibility for contract administration, grievance and disciplinary administration, labor management, and employee relations activities. Duties of this position will include, but are not limited to, the following:

• Oversee the administration and implementation of applicable collective bargaining agreements;
• Research contractual issues and provide technical advice to NYSED directors and program managers on complex technical issues;
• Review and evaluate changes in negotiated agreements, and advise management of their impact on the labor relations program;
• Oversee the administration of the agency grievance program and protocol, and process complex grievance issues;
• Ensure that matters are resolved within the applicable statutory and contractual timeframes, and that decisions are complete and accurate;
• Ensure that grievance decisions are satisfactorily resolved, and that agency determinations are upheld;
• Direct or participate in all statewide labor/management committees and work groups;
• Represent the Department in both statewide and agency-level collective bargaining negotiations;
• Analyze and make recommendations regarding the Memorandums of Agreement and Understanding for unclassified personnel at the New York State Schools for the Blind and Deaf;
• Oversee the agency’s discipline program by providing technical assistance to program managers and supervisors in disciplinary matters;
• Direct investigations and interrogations and make recommendations for appropriate action;
• Review and issue written communications and documents, including notices of discipline;
• Represent Department management in agency-level reviews and hearings;
• Conduct sensitive and complex disciplinary investigations, arbitrations and Section 75 hearings;
• Prepare witnesses for both direct and cross examination, prepare and present opening statements, facilitate witness testimony, prepare and examine case evidence and theory, and respond to motions;
• Deliver closing arguments or prepare written briefs summarizing major points of agency’s case;
• Negotiate settlements where appropriate;
• Oversee all investigations in which physical assault or neglect has been alleged, including cases referred to the Justice Center for the Protection of People with Special Needs and serve as primary agency liaison to the Justice Center;
• Oversee all investigations in which harassment has been alleged and report findings to Department management;
• Assess labor relations training needs and develop training and supporting materials and curricula;
• Deliver training to supervisors of all levels regarding effective labor relations practices, NYS labor contracts, collective bargaining, employee discipline, and related topics;
• Evaluate Department policies and procedures to assess their impact on the Department’s labor relations program, and recommend revisions or new policies;
• Supervise and assign the work of the office, monitor and review completed work, and serve as a mentor and trainer to subordinate professional staff;
• Assist the Governor’s Office of Employee Relations (GOER) in presenting the State’s case at improper practice hearings before the Public Employment Relations Board (PERB);
• Work with the Governor’s Negotiating Committee, PERB, and other agencies and stakeholders to receive and provide information, resolve day-to-day problems and keep abreast of employee relations developments in other agencies and parts of the public and private sectors;
• Represent the Department at meetings and conferences with administrators, legal staff, union officials, GOER, PERB and Civil Service;
• Establish effective working relationships with union personnel to resolve sensitive or complex problems; and
• Assist Counsel’s Office at hearings involving NYSED staff pursuant to the NYS Human Rights Law and participate in investigation meetings conducted by the NYS Division of Human Rights.

Additional Comments CONDITIONS OF EMPLOYMENT: This will be a contingent permanent or non-permanent provisional appointment. Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Filling of this position is contingent upon Division of Budget approval.

*Leads to a maximum salary of $125,629 based on annual performance advances.
