Minimum Qualifications MINIMUM QUALIFICATIONS:

Candidates must be reachable for appointment on the current Civil Service Eligible List, Professional Careers Opportunity (PCO) or OPWDD’s Central Office Public Administration Traineeship Transition (PATT). Appointment will be made at the traineeship level.
Candidates must have permanent competitive status in the posted title and be eligible for lateral transfer; OR be eligible to transfer via Section 70.1, 70.4 or 52.6 of Civil Service Law. The transfer cannot be a second consecutive transfer resulting in an advancement of more than two salary grades.

Duties Description POSITION DESCRIPTION:

The Office for People With Developmental Disabilities (OPWDD) provides high-quality, person-centered services, supports and advocacy to approximately 120,000+ individuals with developmental disabilities in New York State. We are guided in our interactions with the people we serve and each other by compassion, dignity, diversity, excellence and honesty.

The Employee Relations Office (ERO) is responsible for the administration of bargaining unit contract agreements with the public employees’ unions, (CSEA, PEF, NYSCOPBA and Council 82). ERO represents the OPWDD’s Commissioner in the administration of collective bargaining agreements with more than 20,000 state employees. ERO oversees the statewide disciplinary processes of OPWDD employees, answers and resolves grievances, provides advice to human resources professionals related to contract administration issues, offers training to human resource professionals and supervisors on Employee Relations issues such as performance evaluation, grievances, counseling and discipline.

PRIMARY DUTIES AND RESPONSIBILITIES:

Under the direct supervision of the Human Resource Specialist 3 (LR), or higher, the incumbent will be responsible for taking a role in employee discipline, the grievance process, administering the various negotiated contracts and labor/management agreements, and responding to inquiries from managers regarding Employee Relations matters. The Human Resource Specialist 1 will:
• Review investigative reports of employee incompetence and/or misconduct and issue disciplinary charges,
• Conduct or participate in investigations and interrogations,
• Represent the agency in CSEA disciplinary expedited hearings,
• Represent and advocate for OPWDD at disciplinary hearings and resolve disciplinary cases through settlement or binding arbitration.
• Assist other units or managers with administering FMLA, the counseling process, probationary terminations, and more,
• Act as hearing officer for Step 2 grievances,
• Assist in the maintenance of employee relations and associated databases,
• Participate in labor management and subcommittee meetings as needed,
• Consult with other departments or Agencies including OPWDD Counsel, GOER, the Department of Civil Service, in order to facilitate the employee relations process.
