Minimum Qualifications MINIMUM QUALIFICATIONS:

52.6 TRANSFER QUALIFICATIONS: One-year of permanent, contingent-permanent, or 55 b/c service in a title Grade 27/M-2 or higher determined to be administrative by Civil Service. Transfer candidates must also possess a law degree from an accredited college or university and be able to provide evidence of current registration to practice law in New York State.

Duties Description STANDARD DUTIES:

Under the direction of the Counsel and the Deputy Counsel, the Associate Attorney performs complex and difficult professional legal work in the administration and enforcement of the Department’s Labor Standards and Public Employee Safety and Health programs. This includes supervising the Department’s counsel staff representing the Department in a large volume of administrative hearings on complex Labor Standards and Public Employee Safety and Health cases before the Industrial Board of Appeals. You review Answers to Petitions, Motions and supporting Affidavits, Memoranda of Law and Stipulations of Settlement, and manage all related activities of staff including participation in pre-hearing telephone conferences and settlement negotiations. Responsibilities also include continuous review of Counsel’s Office processes and procedures for improved efficiencies; serve as confidential adviser to the Deputy Counsel on Labor Standards and Public Employee Safety and Health proposed legislation, regulations and litigation and on special assignments as requested; respond to inquiries and requests for information, legal opinions and legal interpretations from the Commissioner and other Executive staff; provide clear written and oral communications of legal conclusions; act as the liaison between the Department and the Attorney General’s Office in the defense and prosecution of litigation to which the Department is a party on issues involving Labor Standards and Public Employee Safety and Health matters; assist Legislative Counsel in the review, preparation and submission of Department legislation relating to the Labor Standards and Public Employee Safety and Health programs; recommend and prepare regulations implementing the provisions of the Labor Law relating to Labor Standards and Public Employee Safety and Health and supervise the preparation of Notices of Proposed Rule Making and all supporting forms for publication in the State Register, including the Notices of Final Adoption of Rule Making and all supporting forms; and perform other duties necessary for the proper and efficient operation of Counsel’s Office.
