Duties Description The Department of Financial Services (DFS) is seeking candidates for the position of Senior Attorney in the Office of General Counsel. Duties will include, but are not limited to, the following:

• Performs legal research of statutes, regulations, and court decisions that are pertinent to insurance;
• Reviews, analyzes, and assists in drafting of documents relating to litigation matters, including motion papers;
• Reviews and analyzes insurance holding company act filings, including applications for changes of control and determinations of non-control, affiliate transactions, and corporate restructurings;
• Drafts memoranda regarding research findings, analysis, and recommendations;
• Responds to consumer complaints and legislative inquiries, inquiries from industry representatives or from within the Department concerning insurance policies, annuity contracts, and other insurance products, including interpretation of contract provisions and rights and obligations of the parties to the contracts;
• Drafts legislative proposals with supporting memoranda, regulations with required State Administrative State Administrative Procedures Act materials, and circular letters;
• Critiques or assists in the analysis of draft legislation or regulations proposed by other bureaus, agencies, insurance companies, trade groups or legislators, which affect insurance and financial products and the marketing of such products in New York;
• Participates in Department task forces with industry or other governmental agencies in drafting legislation and regulations;
• Assists field examiners in the identification and research of various issues arising during market conduct examinations and investigations;
• Assists in the processing of violations of the insurance law and regulations, including coordination with other Department business units, such as the Consumer Protection and Financial Enforcement Division and Insurance Division;
• Prepares memoranda and supporting materials and assists the Office of General Counsel in preparation and handling of administrative hearings, including regarding disapproval or withdrawal of approval forms, licensure, and disciplinary actions;
• Reviews and analyzes applications of potential licensees for completeness and compliance;
• Evaluates licensing laws and regulations, and industry trade practices, to identify issues and areas of concern for business units' licensing determinations;
• Evaluates industry trade practices, identifying legal issues and applying public policy in determining acceptability of the content and marketing of insurance policy forms;
• Attends meetings or participates in telephone conferences with industry representatives, attorneys, and consultants to discuss policy form filings or market conduct matters;
• Prepares reports and memoranda on new industry practices, new distribution methods, new products and compliance issues;
• Reviews and analyzes Freedom of Information Law (FOIL) requests and prepares responses; and
• Carries out special projects and assignments as deemed appropriate by Office of General Counsel management and Executive.

Additional Comments Positions located within the New York City metropolitan area, as well as Suffolk, Nassau, Rockland, and Westchester Counties, are also eligible to receive an additional $3,026 annual downstate adjustment.
