Minimum Qualifications • A Bachelor’s Degree from an accredited educational institution and a Juris Doctor from an accredited law school.
• Admission to the New York State Bar
• Minimum twelve (12) years of legal experience, including trials, motions, research and brief writing and supervising attorneys and investigators in complex and sensitive matters, preferably with a prosecutor’s office or a large government investigative agency.
• Demonstrated analytical skills, critical thinking skills, impartial judgment and research aptitude.
• Excellent oral and written communication skills.
• Knowledge of governmental investigative policies and procedures and reporting requirements.
• Knowledge of federal, state, and local civil and criminal laws, rules, regulations, and procedures pertaining to civil and criminal investigations.
• Knowledge of modern investigative techniques and procedures, especially relating to the investigation of complex and sensitive white collar, cyber-criminal, fraud, financial and transportation investigations.
• Knowledge of investigative practices of Inspectors General or other governmental investigative agencies.
• Knowledge of the laws relating to the service of subpoenas and legal processes.
• Knowledge of effective interviewing, interrogation, and investigative techniques.
• Ability to handle multiple projects and responsibilities while maintaining careful attention to detail and accuracy.
• Ability to select, develop and motivate staff to conduct high quality investigative audits and related reviews.
• Ability to work in a high-pressure environment.
• Ability to interact effectively with MTA/OIG Executive and Senior Staff, MTA Headquarters and Agency executives and staffs.
• Knowledge of Microsoft Office 365 modules, including Outlook, OneDrive, SharePoint, Word, PowerPoint and Excel.
• Knowledge of eDiscovery software.
• Subject to the approval of the EDIG/Legal, this position is authorized for tele-working.

Duties Description • Provides leadership in operational responsibility for the day-to-day management and oversight of the Legal Department.
• Responsible for providing executive insights and strategies in the planning, conducting, oversight and carrying out of complaint inquiries and investigations in support of the MTA/OIG mission to uncover waste, fraud, abuse and mismanagement within the MTA and its subsidiary agencies.
• With the senior leadership of the Investigations Department, develops investigative plans and operations reviews based on complaints filed with the MTA/OIG as well as areas of interest, risk assessment, management, and other appropriate investigative inquiries.
• Participates in and assists in conducting regular case and complaint review meetings with members of the MTA/OIG Legal Division and prepares status reports, as necessary, for the EDIGs/Legal & Investigations and other Executive Staff.
• Ensures that all complaint inquiries and case investigations meet required standards of excellence, thoroughness, and compliance with accepted investigative and legal practices as well as compliance with local, state, and federal criminal procedural statutes, where necessary.
• Ensures that all necessary case documents and evidence are uploaded on a timely basis into the MTA/OIG Case Tracking Management System (CMTS).
• Conducts random audits of the Legal Department files maintained in CMTS for quality control and assurance.
• Manages assigned aspects of the work of the MTA/OIG Legal Division to ensure that complaint inquiries and case investigations undertaken are carried out efficiently and without undue delay.
• Coordinates legal staff investigative activities with multi-jurisdictional local, state and federal agencies and task forces as necessary.
• Regularly briefs the Inspector General, EDIG/Legal and members of the Executive Staff on the status of complaint inquiries and case investigations in progress.
• Prepares oral and written reports, correspondence, and memoranda.
• Reviews and approves draft reports prior to their submission to the Inspector General where the EDIG/Legal is recused.
• Identifies and develops training in conjunction with the EDIGs/Legal & Investigations in substantive legal, investigative techniques and related technology practice areas to enhance the investigative capability of the legal and investigative staffs.
• Works with the Director of Information Technology to ensure that the Legal Division staff has access to appropriate investigative analytical software, forensic software and MTA database applications necessary to undertake complaint inquiries and case investigations.
• Serves as the liaison with MTA/HQ, MTA Agency officials, federal, state and local prosecutors’ offices and other law enforcement and other transportation constituencies as requested and appropriate.
• Attends monthly meetings of the MTA Board and its Committees and other meetings as directed or required by the Inspector General.
• Other duties as assigned by the EDIG/Legal or the EDIG/Investigations.
• Serves as the FOIL Appeals Officer
• Travel within the MTA geographic jurisdiction may be required.
• Work outside of regular business hours, including evenings, weekends and holidays may be required.
