Minimum Qualifications Suitable Candidates must possess the following qualifications:
•At least ten (10) years of experience as an attorney, at least two (2) of which involve supervising other attorneys;
•Substantial criminal or civil litigation experience, including participating in trials and/or evidentiary hearings preferred;
•Superb legal analysis, legal writing and editing, and oral advocacy skills;
•Excellent project management, organizational, interpersonal communication, problem solving and teamwork skills;
•Prior experience in conducting and/or overseeing investigations preferred;
•Strong technological skills, including knowledge of and experience with various computer software programs;
•Substantial government, non-profit and/or public policy experience is preferred.

Duties Description The General Counsel reports to the Executive Director, functions as an integral member of the agency executive team and provides legal guidance and services to the Executive Director of the Justice Center, and to other staff, on the variety of issues related to carrying out the mission of the Justice Center. The General Counsel is called upon to draft or provide legal advice and review on a number of matters, including legislation, regulations, contracts, employment and human resources matters, administrative hearings and oversight of litigation. The General Counsel will provide support and advice to the Special Prosecutor and Inspector General as warranted and will support the enforcement of Justice Center rules and regulations. The General Counsel will render advice and legal opinions concerning all programs within the Justice Center in support of the agency’s mission to protect the health, safety and dignity of all people with special needs.
Specific duties will include, but are not limited to:
1.Oversight and ultimate responsibility for the operations of discrete units within the Office of General Counsel including the Case Closure Unit, Records Access and Management Unit and the Criminal Background Check Unit.
2.Oversight and ultimate responsibility for all agency outside litigation, including procuring representation from the Attorney General’s Office as appropriate, as well as procurement, liaison and management of retained outside counsel.
3.Direct liaison to the Office of Counsel to the Governor.
4.Liaison to the General Counsels of other state agencies.
5.Ensuring compliance with all applicable state and federal statutes, rules and regulations.
6.Oversight of agency attorneys engaged in employment law related matters, human resources investigations and related matters.
7.Review and approve all agency legislative proposals and provide comment and advice on pending legislation impacting the agency, its stakeholders and mission.
8.Participate in case review of significant or high-profile investigations.
9.Review and approve all public information request responses and significant FOIL requests.
10.Review and approve all legal or other significant agency policies and guidance.

Additional Comments The New York State Justice Center for the Protection of People with Special Needs (Justice Center) is charged with protecting over one million New Yorkers under the care or jurisdiction of six state agencies. The following list outlines several of the Justice Center’s key responsibilities:
•Advocate on behalf of individuals with disabilities and provide oversight of quality of care.
•Operate a centralized, statewide 24-hour hotline and incident reporting system staffed by trained personnel.
•Operate a statewide register that contains the names of individuals found responsible for egregious or repeated acts of abuse or neglect.
•Centralize and perform functions relating to criminal history background checks.
•Investigate serious allegations of abuse and neglect.
•Prosecute criminal acts of abuse and neglect.
•Analyze abuse patterns and trends in order to prevent future occurrences.
