Bachelor's degree in Business Administration, Accounting, Public Administration, Urban Studies, or Construction Management plus seven years relevant experience, including four years experience supervising and evaluating professional staff in an MWBE or related program. Management experience. Working understanding of building design and construction. Working knowledge of Articles 15-A and 17-B of the Executive Law, affirmative action contract compliance and other applicable laws and an understanding of the impact and application of such laws/regulations.

Duties Description Primary Purpose
The Assistant Director, Opportunity Programs supervises the highly diversified and complex operations of the Opportunity Programs unit, ensuring pre- and post-award compliance with Executive Law Article 15-A and Article 17- B, Public Authorities Law, set-aside legislation, and other related rules and regulations.
Essential Functions
• Develop and supervise implementation of contract compliance programs.
• Assist in the preparation and monitoring of the unit operating budget and technical and management consultants' budgets.
• Analyze cost estimates for all applicable DASNY projects to identify opportunities for minority-, women-, and service-disabled veteran-owned business participation and establish participation goals consistent with Executive Law Article 15-A and Article 17-B.
• Assign minority-and women-owned business enterprises (MWBE), service-disabled veteran-owned businesses (SDVOB), and minority and women workforce (EEO) goal values to all applicable DASNY contracts.
• Develop and monitor implementation of programs and procedures designed to mitigate the effects of systemic discrimination against minority group members and women.
• Conduct pre-award reviews of all proposed construction contractors, construction consultants, and professional service firms, in relation to compliance with pre-award requirements of Executive Law Article 15-A and Article 17-B.
• Review and approve utilization plans for all contracts subject to Executive Law Article 15-A and Article 17-B.
• Evaluate MWBE and SDVOB goal waiver requests; provide Senior Director with recommendations on disposition of the waiver request.
• Supervise implementation of post-award monitoring programs.
• Conduct contract compliance meetings with contractors and construction consultants that appear to be in non-compliance with the MWBE and SDVOB provisions of their contracts.
• Coordinate and participate in fact-finding meetings and recommend imposition of liquidated damages against contractors determined to be in non-compliance with the provisions of Article 21 (affirmative action) of their general conditions contracts.
• Supervise the MWBE and SDVOB outreach program.
• Recommend capacity building, technical assistance, and other support programs to facilitate the successful participation of MWBEs and SDVOBs to the Senior Director.
• Facilitate early intervention when MWBEs and SDVOBs are experiencing difficulties with receiving timely payments or carrying out the provisions of their contracts, subcontracts, and purchase orders.
• Review and approve all Opportunity Programs unit close-out requests for Executive Law Article 15-A and Article 17-B contractors and consultants. Assume the responsibilities of the Senior Director, Opportunity Programs in their absence.
• Manage and supervise assigned staff.

Other Duties and Responsibilities
• Develop and supervise implementation of contractor orientation and training programs.
• Coordinate with DASNY staff, such as unit directors, chiefs, and design and construction managers as required.
• Participate in MWBE, SDVOB, and related forums and events.
• Train and evaluate employees.
• Develop, document and implement policies and procedures.
• Assess, develop and implement internal controls, and oversee the review and testing of same.
• Undertake special assignments as directed.
• Must maintain regular attendance in accordance with DASNY attendance and leave policies.
• Must adhere to the NYS Information Security Policy Standards established and issued by the Office of Information Technology Services. (Standards can be found on the Intranet).

Additional Comments Supervision
Supervision of employees is required.

Physical/Mental/Visual Demands
Weekly travel is required, using public transportation, DASNY vehicle, rental vehicle or personal vehicle. This travel may include overnight stays at public accommodations and related establishments. Requires exposure to all work-safety hazards of a construction site. Requires complex and time-pressured decision- making. Must be available to work overtime or extended work hours as needed.

**Position rates additional $5,054 annual location differential**
