Minimum Qualifications Permanent Transfer Candidates: NYS employee with one year of permanent or contingent-permanent competitive service as a Senior Attorney (G-25); OR a NYS employee with one year or more of permanent or contingent-permanent competitive service in a title at Grade 23 or above with current NYS Bar Admission and eligible for transfer to Senior Attorney under Sections 70.1, 70.4, or 52.6 of the Civil Service Law. (Candidates requesting consideration for transfer must also be a graduate of an accredited law school with a LLB or JD degree, and may also need to meet additional experiential conditions to qualify for consideration.)

Open Competitive Minimum Qualifications: 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience. This position may also be filled at the Assistant Attorney levels 1-3 based dependent upon Law school graduation and NYS Bar Admission status as defined on exam announcement: https://www.cs.ny.gov/examannouncements/announcements/oc-cr/20-131.cfm

The preferred candidate must have strong legal skills, be able to work as a member of a team, have demonstrated good decision-making skills, possess excellent oral and written communication skills, and must have the ability to handle high-volume activities in a dead-line driven environment. The ability to organize and prioritize a high volume of tasks is critical. The preferred candidate should be a highly motivated individual interested in working in an active legal team environment addressing public health issues.

Duties Description Senior Attorneys provide legal assistance and support to Department of Health (DOH) program administrators by analyzing legal opinions, briefs and other material, preparing memoranda of law and conferring with administrators or parties to legal action in
order to mediate, negotiate or settle legal issues directly related to the agency's program. Senior Attorneys function either as specialists in a single program governed by law or in a more general atmosphere as evidenced by their concern with laws governing numerous programs.This position will deal with areas of law such as epidemiological matters (COVID-19), communicable diseases, Medicaid rate setting, Medicaid eligibility determinations, managed care, health care reform, health facility licensure, surveillance, and regulation, environmental health and hazards, hazardous wastes, sanitary code, vital records, bankruptcy, collections, funeral director and cemetery, social services, mental health, developmental disabilities, enforcement actions and administrative determinations, patient abuse, NYS owned and operated Veterans’ Homes and Helen Hayes Hospital, and matters related to the Wadsworth Laboratory. The Incumbent will be responsible for the performance of the full range of legal activities in support of one or more programs within the DOH, and perform all technical work and may serve on a regular basis as a legal advisor to program administrators and managers in the day-to-day operation of DOH programs. This technical legal work involves the analysis of legal issues, preparing briefs, researching statutes, decisions, opinions and other sources for use in the preparation of briefs or recommendations, drafting or reviewing contracts, leases, agreements, and legislation and presenting oral arguments either at judicial or administrative proceedings.
