Job Specifics
Minimum Qualifications Education Level required: J. D. or LLB from an accredited law school; admission to New York State Bar.
Relevant experience required: Minimum of 4 years of legal experience. Litigation experience preferred.
Knowledge preferred: Litigation, familiarity with administrative hearings and the New York State Administrative Procedure Act (SAPA). Supervisory or managerial experience preferred.
Duties Description BASIC FUNCTION:
Conduct hearings, adjudicate written appeals, issue recommended decisions in cases arising from appeals of denials of certification as a Minority and Women Owned Business Enterprise (MWBE) by New York State’s Division of Minority and Women’s Business Development (DMWBD).
WORK PERFORMED:
• Serve as Chief Administrative Law Judge (CALJ) at the New York State Department of Economic Development (DED). The CALJ supervises administrative law judges (ALJs)and support staff within DED and is responsible for oversight and supervision of all hearings and written appeals to which DED ALJs are assigned.
• CALJ will oversee assignment of matters to ALJs. Ensure ALJs produce timely recommendations.
• Review notices relating to hearings, ensure proper processes in connection with conduct of hearings and appeals pursuant to applicable law and regulations, ensure that administrative appeals are conducted in a fair and efficient manner.
• Assist with training and education of administrative law judges.
• Conduct hearings by remote means and/or in-person as required or as requested, evaluate evidence, maintain proper administrative procedures.
• Provide recommended decisions after hearings and/or written appeals based on the relevant laws and regulations. Rule on motions, receive evidence and testimony.
• Conduct settlement conferences.
