Minimum Qualifications Ideal candidate will have a minimum of five (5) years of criminal defense experience.

Duties Description The Assistant Counsel will assist in the Office’s implementation of the reforms specified in Executive Law § 832 (4) for the development and implementation of written plans to (1) ensure that criminal defendants eligible for publicly funded legal representation are provided in person representation at his or her arraignment (2) establish numerical caseload/workload standards for each provider of legally mandated publicly funded representation in criminal cases for persons unable to afford to counsel and (3) improve the quality of legally mandated publicly funded representation in criminal cases for persons unable to afford counsel. The holder of this position will serve as Statewide Implementation Attorney – Counsel at First Appearance and will report to the Statewide Chief Implementation Attorney, who works under the guidance of the Director of the Office of Indigent Legal Services (Director) and agency Counsel (Counsel). The holder of this position will be primarily responsible for implementation of the Counsel at First Appearance reforms specified in Executive Law § 832 (4)(a) and will work closely with other staff in the Statewide Implementation Unit to satisfy the Office’s new statutory duties and responsibilities and to improve the quality of mandated representation under article 18-B of the County Law. All case-related information and knowledge obtained in the performance of these duties is highly confidential and may be subject to the attorney-client privilege.

Specific responsibilities also include:

• Evaluates and monitors the legal services provided at a defendant’s first appearance in court in New York City (City) and counties in New York State (other than the five counties named in the Hurrell-Harring settlement agreement) (counties), pursuant to article 18-B of the County Law.

• Consults with the providers of legal representation and officials in the City and counties in order to identify opportunities for providing in person representation of eligible defendants at first appearance and improving the quality of such representation.

• Assists in the development of written plans, in accordance with the provisions of Executive Law § 832 (4), for the City and counties to provide in person representation of eligible criminal defendants at his or her first appearance in court.

• Monitors the progress of the City and counties toward achieving the goals enunciated in the written plans to provide in person representation of defendants at his or her first appearance in court, including developing regular, periodic reports in accordance with the provisions of Executive Law § 832 (4)(a)(iv).

• Makes recommendations to the Statewide Chief Implementation Attorney for improving the monitoring and reporting of progress made by the City and counties in providing in person representation of defendants at his or her first appearance in court, including improving the quality of such representation in a cost-effective manner, by increasing the availability of necessary support services or creating innovative systems for the provision of representation at a defendant’s first appearance in court.

• Works with the City and county providers and officials to develop support for the implementation of the provisions of Executive Law § 832 (4), in order to achieve maximum quality enhancement and cost-effectiveness.

• Undertakes such other activities as may be requested by the Director and Counsel in furtherance of the Office’s overall responsibility to implement the provisions of Executive Law § 832 and make efforts to improve the overall quality of indigent legal services representation under article 18-B.
