Job Specifics
Minimum Qualifications MINIMUM QUALIFICATIONS: Admission to the New York State bar, and seven years of relevant, post-graduation experience, including significant trial or administrative hearing work, is required. Criminal or administrative prosecution experience is desirable. Applicants must also be familiar with use of personal computers and word processing.
Duties Description The Office of the Professions receives in excess of 6,500 complaints of professional misconduct annually. This results on an average of over 1,100 cases being referred to its Prosecutions Division for appropriate resolution. The Director of Prosecutions position is indispensable to the timely and effective disposition of this volume of cases. Duties of the position include but are not limited to:
• Overall supervision of all responsibilities of the Prosecutions Division throughout the state, encompassing nineteen prosecutors assigned to eight regional offices.
• Maintain the flow of cases through the disciplinary process, resulting in 1,500 prosecutions annually.
• Evaluate cases for seriousness and complexity. Identify high priority cases and address these cases expeditiously.
• Directly supervise two Deputy Directors of Prosecutions (M-4) and review all aspects of their responsibilities, including the screening of all cases prior to their referral for disciplinary action.
• Direct the training of staff, manage personnel effectively and shift resources to meet changing priorities.
• Work with Director of the Division of Investigations in developing procedures for efficient receipt and disposition of cases.
• Manage the consent process and the presentation of cases to the Regents Review Committee, Committee on the Professions and the Board of Regents.
• Complaint Resolution Process Early Involvement: Coordinate the availability of prosecutors for review of in-coming complaints with investigators and members of the State Boards for the Professions.
• Informal Settlement Conferences: Serve as facilitator at Informal Settlement Conferences when necessary.
• Reduce pending disciplinary cases cycle time and ensure that all cases that cannot be resolved with an agreement will proceed to either a Calendar Call or the next available Regents Review Committee date.
• Coordinate outreach activities; coordinate training activities with the Executive Secretaries of the State Boards and interaction with the Professional Assistance Program.
Additional Comments CONDITIONS OF EMPLOYMENT: This position is in the exempt class, and the incumbent serves at the discretion of the Commissioner of Education. Occasional overnight travel throughout the state should be expected.
