Job Specifics

Minimum Qualifications Applicants must have a minimum of seven (7) years of experience litigating in state and federal courts, including motion practice, discovery, trials, and complex evidentiary hearings. Applicants must possess superior research, writing, and oral advocacy skills.

Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the OAG be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.

Duties Description The New York State Office of the Attorney General (OAG) is seeking an experienced litigator to serve as an attorney in the Education Section of the Litigation Bureau in the New York City office.

The Litigation Bureau represents the State of New York and its agencies and officers in state and federal courts in legal actions and proceedings relating to civil rights, education, social services, public employment, public health, law enforcement, corrections, state finance, insurance, taxation, and other litigated matters arising out of state operations and legislation.

The Education Litigation Section primarily represents the State University of New York, the City University of New York, and the State Education Department. Additional clients include the Office of the State Comptroller, Higher Education Services Corporation, and the Department of Transportation. The Section’s attorneys defend a wide variety of state and federal court actions involving, among other things, constitutional, civil rights, labor and employment, state regulation, and administrative law issues. The Section’s cases present a myriad of questions on constitutional law and statutory/regulatory interpretation, including matters of first impression, and generally have significant financial and policy implications for the State. Responsibilities include acting as lead or secondary counsel on a variety of litigation matters; preparing briefs and motion papers; appearing in court; engaging in oral argument; managing discovery; negotiating settlements; and conducting trials, as well as other duties, as assigned.
