Job Specifics

Minimum Qualifications We are seeking a candidate with at least five (5) years of civil litigation experience. Experience in some or all of the following areas is preferred but not required: supervision of other lawyers; development and management of complex investigations or impact litigation; and affirmative investigations or litigation of health-related violations.

Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Office be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.

Duties Description The New York State Office of the Attorney General’s Health Care Bureau (HCB) is seeking an experienced attorney to serve as the Tobacco Enforcement Section Chief (Section Chief) of the HCB’s tobacco docket in the New York City office. The Health Care Bureau seeks to protect consumers from deceptive or illegal practices and to ensure access to health care by bringing civil prosecutions for violations of health, insurance, deceptive practice, antidiscrimination and other applicable laws. The HCB also brings cases in federal and state courts to enforce anti-cigarette trafficking laws and enforces the Tobacco Master Settlement Agreement (MSA) entered into between the major tobacco companies and fifty-two (52) states and territories. More specifically, the HCB enforces the MSA’s public health provisions prohibiting tobacco companies from engaging in marketing and advertising aimed at youth. In addition, the HCB provides oversight of the State’s compliance with the regulatory obligations of the MSA in order to ensure that New York receives its share of annual tobacco settlement payments; that litigation involves such issues as the Contraband Cigarette Trafficking Act and tax evasion.

The Section Chief will be a critical part of the Health Care Bureau’s leadership. The Section Chief will develop the HCB’s tobacco enforcement strategies and supervise lawyers who investigate and litigate matters concerning tobacco using a strategic enforcement model. In addition, the Section Chief will help oversee the Bureau’s tobacco public policy work and outreach to stakeholders. The Section Chief will report to the Deputy Bureau Chief and work closely with the Bureau Chief.
