Job Specifics
Minimum Qualifications The ideal candidate has five (5) years of federal and/or state court civil litigation experience, including experience handling civil rights or 42 U.S.C. § 1983 actions. However, a minimum of two (2) years of experience (including judicial clerkships, if any) is required. Superior writing, analytic, oral advocacy and organizational skills are also required.
Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Office be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.
Duties Description The Law Enforcement Group (LEG) of the Litigation Bureau in the New York State Office of the Attorney General (OAG) is seeking an experienced litigator to serve in the New York City office. The Litigation Bureau defends the State of New York, and its agencies and officers in state and federal courts in civil actions and proceedings relating to civil rights, education, social services, public employment, public health, law enforcement, corrections, state finance, insurance, taxation, and other litigated matters arising out of state operations and legislation.
Attorneys assigned to the LEG primarily defend the Department of Corrections and Community Supervision (DOCCS) and the New York State Police, and their officers, in federal and state courts in civil actions involving constitutional and civil rights, as well as employment issues. Among other things, the LEG handles a large number of federal civil rights actions brought against DOCCS involving prisoners’ rights, and against the State Police for false arrest, including class actions and complex litigation concerning challenges to important governmental programs and policies in the corrections and criminal justice fields. LEG’s litigation addresses a wide range of issues, including first amendment rights of freedom of religion and speech, accommodation of mental and physical disabilities, and constitutional challenges to state statutes, regulations and policies. Attorneys handle all phases of litigation from inception through trial, and have frequent opportunities to appear in court. The LEG also has an active docket of federal jury trials.
