The duties that the incumbent of the vacancy will be expected to perform. Duties Description Primary Purpose
The Opportunity Programs Group Analyst monitors and ensures contractors, professional service firms, consultants and vendors doing business with DASNY funded or monitored projects maintain compliance with Executive Law Article 15-A, Executive Law Article 17-B, labor laws and other applicable federal, state and local laws.
Essential Functions
Monitor the compliance of contractors and consultants with the MWBE and Service-Disabled Veteran-Owned Business (SDVOB) participation goals established for DASNY contracts.
Audit payments made to MWBE & Service-Disabled Veteran-Owned Business subcontractors and suppliers listed on approved utilization plans obtaining confirmation of amounts paid and the timeframes within which payments are made.
Track MWBE and Service-Disabled Veteran-Owned Business participation achieved by contractors /consultants.
Assist contractors / consultants to identify New York State-certified MWBE and SDVOB subcontractors and suppliers.
Monitor and audit construction and professional services contracts, including term contracts, and work authorizations assigned under various DASNY programs such as, but not limited to Job Order Contracting (JOC), General Construction Community Minor Maintenance (CMM), and the Discretionary Spending Program.
Conduct periodic desk audits and compliance reviews using the New York State Contract System, E-Gordian, other systems, and hard-copy documentation on assigned construction/professional service contracts and initiate appropriate follow-up activities. Ensure compliance with various state and federal laws. Interview project workers to endure fair employment, labor practices, and wages.
Ensure that DASNY receives copies of executed subcontract agreements/purchase orders, and no changes are made to the MWBE and SDVOB subcontractors and suppliers listed in approved utilization plans without DASNY’s prior written approval.
Ensure that contractors/consultants submit, where required, monthly Workforce/EEO reports.
Coordinate with DASNY design, construction and other staff as well as outside consultants and contractors.
Make random site visit and attend various project-related meetings, such as pre-bid, kick-off, progress, non-compliance and close-out meetings on contracts assigned.
Educate contractors, consultants and other vendors on DASNY policies and procedures, applicable state laws, and state registry process. Provide assistance with questions regarding preparation and implementation of utilization plans. Assist prime contractors, consultants and DASNY Project Managers in identifying N.Y.S. certified MWBEs and SDVOBs and/or areas for sub-consultant participation.
Review all formal requests for waivers and ensure submission is complete in accordance with DASNY’s Good Faith Effort guidelines.
Recommend acceptance or rejection of changes to DASNY-approved consultant utilization plans to the Assistant Director, Opportunity Programs Group or designee. Contact MWBEs and SDVOBs listed on utilization plan, as required.
Provide contractors and consultants on contracts assigned with written notification of deficiencies, corrective actions required, and timeframes for resolution of issues. Prepare and send deficiency notices in accordance with DASNY program guidelines to contractors and consultants that are in non-compliance.
Confer with the Assistant Director, Opportunity Programs Group or designee on non-compliance issues and recommend suspension of progress payments or other punitive action as necessary.
Attend construction progress meetings, as needed, to determine whether MWBE and SDVOB contractors are experiencing problems in the performance of their work. Notify DASNY Project Manager or other DASNY staff of problems, where appropriate.
Assist with outreach activities and initiatives to MWBE, SDVOB and Small Businesses.
Coordinate requests for closeouts with applicable staff.
Use MWBE, SDVOB and other databases/tracking systems to monitor projects/contracts and input applicable information. May maintain various reports, spreadsheets, logs and/or other databases of information.
Organize and maintain Opportunity Programs Group project files for contracts assigned.
Review all outgoing office correspondence related to contracts assigned for accuracy.
Perform other task, duties and responsibilities as assigned to advance DASNY’s mission and ensure compliance with MWBE and SDVOB participation goals and applicable laws.
Other Duties and Responsibilities
May be required to participate in forums and other events organized by entities such as chambers of commerce, trade associations, and community organizations.
May represent the Opportunity Programs Group unit on consultant selection committees, review letters of intent and requests for proposal, and complete selection matrix.
May be required to participate in small business, MWBE, SDVOB and other forums and events organized by offices and agencies of New York State and New York City.
Assist with the development, documentation and implementation of procedures.
Assist with the assessment/development and implementation of internal controls and participate in the review and testing of same.
Undertake special assignments as directed.
Must maintain regular attendance in accordance with DASNY attendance and leave policies.
Must adhere to the NYS Information Security Policy Standards established and issued by the Office of Information Technology Services. (Standards can be found on the Intranet).
Supervision
Supervision of employees may be required.
Physical/Mental/Visual Demands
Weekly travel is required using public transportation, DASNY vehicle, rental vehicle or personal vehicle. This travel may include overnight stays at public accommodations and related establishments. Requires exposure to weather and temperature extremes, loud noises, and other work safety hazards (chemicals, fumes, etc.) of a construction site. Requires physical mobility (movement from place to place) and complex and time-pressured decision-making. Overtime or extended work hours may be required.
Work Environment
Standard office environment, including the use of one or more of the following: PC, telephone, fax machine, printer, copier, scanner, electronic stapler/hole punch/date stamp, shredder.

Bachelor’s degree plus three years relevant experience or Associate’s degree plus six years’ relevant experience or High School diploma or equivalent plus eight years of DASNY relevant experience. Experience using databases and generating reports from such databases.
Preferred Qualifications
Bachelor's degree in business administration or related field plus three years relevant experience strongly preferred or Associate’s degree plus six years’ experience in MWBE, SDVOB and Affirmative Action contract compliance including knowledge of Article 15A of the Executive Law and other applicable laws. Experience using databases and generating reports from such databases. Knowledge of Article 15-A of the Executive Law, Article 17B of the Executive Law and other applicable laws, Affirmative Action contract compliance and other applicable laws and an understanding of impact and application of such laws/regulations.
