Minimum Qualifications Position may be filled at the Senior Attorney level or one within the Legal Traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected.

Reassignment – Currently in the title and an employee of DEC
Or
Reinstatement Eligible – Previously held the title on a permanent competitive basis or held a title as indicated under the transfer eligible section on a permanent competitive basis
OR
Transfer Eligible – One year of permanent competitive service at Salary Grade 15 or higher and either:
Eligible for transfer under Section 70.4: Must meet the open competitive minimum qualifications below;
Or
Eligible for transfer under Section 52.6: Must have current or prior service in a title designated as 52.6 within two salary grades/one M grade of this position. In addition, you must be a graduate of an accredited law school with an LLB or JD degree and/or be eligible to take the New York State Bar examination. If you are not admitted to the NYS Bar within two years of appointment, your appointment will be terminated.
OR
Eligible for transfer under Section 70.1: Permanent competitive service as a Senior Attorney or Senior Attorney Realty.

55b/c candidates must meet the open-competitive minimum qualifications below and include with their resume or application, a copy of the letter from Civil Service which indicates approval for the 55b/c program.

Open competitive minimum qualifications (provided for 55b/c candidates and 70.4 transfer eligibles): graduate of an accredited law school with an LLB or JD degree and/or be eligible to take the NYS Bar examination. Duties Description The Senior Attorney position requires a wide range of legal responsibilities serving a variety of DEC programs including Water, Air, Lands & Forests, Materials Management, Mineral Resources, Pesticides, Environmental Permits, Environmental Remediation, Petroleum Bulk Storage, Ecosystem Health, and the Office of Public Protection to further departmental interests. This includes advising staff regarding the application of law and policy to issues related to the Department's jurisdiction.
For all programs other than Environmental Permits, this includes drafting administrative Orders on Consent, negotiating terms of such Orders, drafting pleadings and other prehearing documents for cases that cannot be settled, and representing DEC in calendar calls, mediations, prehearing proceedings, and adjudicatory enforcement hearings.
For Environmental Permits the position requires advising staff and the public regarding Uniform Procedures Act, the State Environmental Quality Review Act, State Administrative Procedures Act, hearing procedures, and representing staff in settlement conferences and adjudicatory hearings regarding permits. For Environmental Remediation additional duties may include negotiation or interpretation of Brownfield Cleanup Agreements and the application of Navigation Law. This position also supports the Bureau of Real Property Services regarding real estate issues, including application of common law related to real property, interpretation of the terms of deeds and easements, and boundary and title disputes. For Lands and Forests the position requires application and interpretation of Article XIV of the State Constitution (the Forest Preserve provision), Conservation Easements, and Unit Management Plans. Finally, the position requires support to staff regarding application of the Freedom of Information Law and the Personal Privacy Protection Act.

Additional Comments Must have a valid driver's license or demonstrate the ability to meet the transportation needs of the position. Travel may be required.
