Minimum Qualifications Transfer: Candidates must have one year of permanent, competitive, or non-competitive 55b/c service as a Senior Attorney OR be in a qualifying title, SG-23 or above, deemed eligible for transfer under Section 52.6 or 70.1 of the Civil Service Law. Candidates must possess a Juris Doctorate degree AND be admitted to the Bar to practice law in New York State or in a state with Bar reciprocity. Candidates who are currently NYS employees in Senior Attorney, Assistant Attorney 1, Assistant Attorney 2, or Assistant Attorney 3 titles may be eligible for transfer.
Eligible List: Candidates who are not NYS employees and eligible to transfer must be reachable on the Legal Specialties exam list. Candidates on the eligible list may receive a canvass letter. To be considered for this position, you must complete and return the canvass as instructed on the letter. Individuals who have not taken the Legal Specialties exam are not currently eligible for appointment, but may be considered for future vacancies pending reachability on the list. Traineeship: This position may also be filled as a traineeship at the Assistant Attorney 1, 2, or 3 levels. Traineeship candidates are appointed from the Legal Specialties exam list, see information on Eligible List above.
Traineeship appointment levels are based on the candidate’s NYS Bar status and post-Bar experience. Candidates appointed at the trainee level will be required to successfully complete the traineeship to advance to the journey level title and salary. Requirements for appointment at the traineeship levels are as follows:
• Assistant Attorney 1: Law school graduation and/or eligibility for NYS Bar Admission. Hiring Rate: $61,270.
• Assistant Attorney 2: Admission to NYS Bar with less than 12 months of post-Bar satisfactory legal experience. Hiring Rate: $67,897.
• Assistant Attorney 3: Admission to NYS Bar and 12 months, but less than 24 months of post-Bar satisfactory legal experience. Hiring Rate: $75,340.

Duties Description The Office of the Medicaid Inspector General (OMIG) is an independent entity created within the New York State Department of Health to promote and protect the integrity of the Medicaid program in New York State.
In furtherance of its mission, OMIG conducts and coordinates the investigation, detection, audit, and review of Medicaid providers and recipients to ensure program integrity.
OMIG works closely with external stakeholders, such as the federal Centers for Medicare and Medicaid Services (CMS), the Office of the Inspector General (OIG), the New York State Attorney General's Medicaid Fraud Control Unit (MFCU), the Bureau of Narcotic Enforcement (BNE), and other state agencies. OMIG has the authority to pursue civil and administrative enforcement actions against any individual or entity that engages in fraud, abuse, illegal or inappropriate acts, or unacceptable practices.
Within the Office of Counsel, attorneys provide support to other agency divisions in the form of legal advice, review and analysis, and legal research of issues relating to Medicaid. Senior Attorneys assist and advise staff on issues relating to the application of Medicaid laws, rules and regulations and policies affecting OMIG’s activities, operations and/or overall mission, and legal matters that arise in litigation. Senior Attorneys may be assigned to handle litigation filed in both state and federal courts involving a variety of issues or subject areas such as estate matters and mortgage foreclosure actions related to Medicaid lien recoveries; temporary restraining orders and injunctions; healthcare compliance; healthcare fraud and restitution to the NY Medicaid Program; statistical sampling methods in Medicaid recoveries; and substantial evidence questions in final administrative determinations.
Additional duties may include: handling and processing FOIL requests on behalf of the agency, assisting in identifying providers who have filed for bankruptcy, reviewing vendor contracts as part of New York State’s procurement process, working with the Attorney General’s Office to file or enforce a judgment against a provider, negotiating and drafting answers, memoranda of law and other responsive documents, responding to discovery requests, obtaining and assisting in the preparation of affidavits and in the development of OMIG’s legal position and strategy towards the case. Additionally, Senior Attorneys are responsible for representing the OMIG in administrative hearings involving the recoupment of money from, and/or the imposition of, a sanction against Medicaid providers. These duties include preparing the case for hearing, conducting witness preparation, performing direct and cross examination, preparing opening statements and post-hearing briefs, and reviewing and obtaining the necessary documents for use in the administrative hearing.
