Minimum Qualifications NYS employee with one year of permanent or contingent-permanent competitive service as a Senior Attorney (G-25); OR a NYS employee with one year or more of permanent or contingent-permanent competitive service in a title at Grade 23 or above with current NYS Bar Admission and eligible for transfer to Senior Attorney under Sections 70.1, 70.4 or 52.6 of the Civil Service Law. (Candidates requesting consideration for transfer must also be a graduate of an accredited law school with a LLB or JD degree, and may also need to meet additional experiential conditions to qualify for consideration.)

Preferred Qualifications: The preferred candidate should be a highly motivated individual interested in working in an active, investigative/legal team environment. The preferred candidate must be able to work as a member of a team, have demonstrated good decision-making skills, oral and written communication skills and should have the ability to handle high volume activities in a dead-line driven environment. Working knowledge of the Penal Law, Criminal Procedures Law, and familiarity with the criminal justice/penal system desirable.

Duties Description The Senior Attorney is a member of a team of other senior attorneys and legal specialists who review the criminal history (Rap Sheets) for unlicensed individuals for suitability of employment in nursing homes and home health care agencies. The daily duties of an attorney in CHRC are: 1) to review new rap sheets to determine whether an applicant should receive an initial denial (pending denial) or approval for employment based only on a review of the convictions the applicant has; 2) to review pending denial cases that are more than 30 days old to determine whether an applicant may now be approved because sufficient proof of rehabilitation has been submitted or should be finally denied because of insufficient proof of rehabilitation; 3) to review all applicants again when the applicant seeks new employment at a different provider; 4) to notify providers of any new charges an applicant may acquire in New York State. Some of these decisions take more deliberation, such as in the case of final determinations, some less, but all decisions are time consuming. Re-reviews of prior decisions are also a constant part of each attorney's workload. The attorney will also handle telephone and e-mail inquiries from employees, their attorneys and providers about the status of determinations, answer inquiries from and contact courts, law enforcement, and defense attorneys and prosecutors for additional/clarifying information.
