Salary RangeFrom $143454 to $180438 Annually
Minimum Qualifications Law degree from an accredited law school; admission to, and member in good standing of, the New York State Bar; and eight years of relevant post-bar experience.
Preferred Qualifications - A good working knowledge of Workers’ Compensation law and the legal issues arising in the administration of the statute. Legislative Counsel experience a plus.
Duties Description Under general direction of the Executive Director of the Workers’ Compensation Board, is responsible for the efficiency and effectiveness of all operations and functions of the Office of General Counsel and serves as Counsel to the Board with respect to all legal and legislative matters.
• Directs the overall operation and supervision of the Office of General Counsel.
• Attends meetings of the Full Board, provides expert legal counsel, and renders opinions as requested.
• Accompanies the Chair and the Executive Director to meetings of the Advisory Committees, legislative hearings, and other conferences and meetings where the need for expert legal counsel is indicated.
• Cooperates with the Attorney General in all litigation and proceedings affecting the Board. Reviews all litigation against the Board and assists in the preparation of pleadings and briefs.
• Cooperates with heads of legal staffs of other State agencies whose functions are related to those of the Board.
• Provides expert legal assistance to the Chair and the Executive Director in the preparation and development of proposed legislation affecting the varied programs of the Board. Serves as the Chairman’s legal advisor at legislative sessions and at committee hearings.
• Supervises the Health Provider Discipline Unit relating to investigations and findings of misconduct by authorized providers.
• Supervises the professional Practice Unit was developed to focus on issues regarding attorneys and representatives who appear before the board
• Supervises the Adjudication Division, to ensure proper formal and informal resolution by conciliators and Workers’ Compensation Law Judges
• Supervises the Administrative Review Division, and Full Board Review team, with respect to all processes involving administrative appeals.
• Supervise legal operations involving Paid Family Leave (PFL), including regulations, PFL discrimination, and the administration of the statutory Arbitration contract.
• Serve directly as, or supervise, a FOIL officer, a Records Access Officer, and a FOIL appeals officer.
