Minimum Qualifications Qualifications for the SEC position are as follows:
• A minimum of ten (10) years of experience litigating fraud, securities fraud or other business activities and financial products in New York State courts.
• Expertise in state court procedure and in the CPLR.
• Experienced in taking and defending depositions and conducting TRO and preliminary injunction hearings, oral arguments and trials.
• Knowledge of the Martin Act, federal securities laws and other states’ securities laws.
• Excellent analytical, research, oral advocacy and legal writing skills, including experience editing the writing of other attorneys.
• Collegial and collaborative with strong interpersonal communication skills.
• Prior experience supervising, coaching and mentoring attorneys and support staff is a plus.
• Experience managing and participating in multi-state or multi-agency investigations is also a plus.
Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that OAG attorneys be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.
Duties Description The Office of the New York State Attorney General (OAG) is seeking an experienced attorney, preferably with securities litigation experience, to lead Investor Protection Bureau (IPB) affirmative litigation matters. IPB, which has both regulatory and enforcement authority, is charged with protecting the public from fraud and misrepresentation in the offering and sale of securities, commodities, franchises and other investment products. IPB evaluates complaints, conducts civil investigations and litigates matters pursuant to New York’s securities fraud statute, the Martin Act, and New York’s Executive Law. The Senior Enforcement Counsel (SEC) will be responsible for leading IPB’s state court actions and summary proceedings and will also be expected to maintain an investigations caseload. The SEC position is located in New York City and reports to the Bureau Chief and Deputy Bureau Chief.
