Minimum Qualifications NYS employee with one year of permanent or contingent-permanent competitive service as a Senior Attorney (G-25); OR a NYS employee with one year or more of permanent or contingent-permanent competitive service in a title at Grade 23or above with current NYS Bar Admission and eligible for transfer to Senior Attorney under Sections 70.1, 70.4, or 52.6 of the Civil Service Law. (Candidates requesting consideration for transfer must also be a graduate of an accredited law school with a LLB or JD degree, and may also need to meet conditions to qualify for consideration.)
Preferred Qualifications: The preferred candidate should be a highly motivated, detail-oriented individual interested in working in an active legal team environment. The preferred candidate must have strong legal skills, be able to work as a member of a team, have demonstrated good decision-making skills, possess excellent oral and written communication skills and should have the ability to manage a varied and demanding caseload and meet regular deadlines.
Duties Description This position is assigned to the Bureau of Administrative Hearings in the Department of Health’s Division of Legal Affairs. The incumbent will:
1.) initiate and represent the Department in enforcement proceedings against individuals and entities alleged to have violated New York health laws and regulations;
2.) review and assess enforcement referrals;
3.) draft formal hearing notices and charges;
4.) negotiate and draft settlement documents;
5.) prepare for and conduct hearings;
6.) draft emergency Commissioner’s Orders necessary to prevent imminent threats to the public health and safety, and to defend challenges to these Orders in administrative hearings;
7.) The incumbent will work closely with and provide enforcement-related advice to the Department’s numerous programs and offices, which are the Bureau’s clients.
