Minimum Qualifications In order to be considered for appointment, candidates must be reachable from the appropriate Civil Service eligible list or be eligible for reassignment or transfer in accordance with Civil Service Law.

Duties Description Candidates selected as a Professional Engineer 1 (PE1) within NYSDOT’s Division of Legal Affairs, Claims Bureau will perform the following duties:

1. Investigate and analyze claims against the State, including Contract Claims, Tort Claims, Appropriation Claims, and Small Claims.

2. Research and assemble evidence and relevant records relating to individual claims.

3. Confer with other Department Engineers and Managers to obtain information and to ascertain appropriate Department Standards, Policies, Methods and Procedures relevant to the claim.

4. Prepare comprehensive reports with an engineering analysis of the claim and aids in formulating the Department's position regarding trials, settlements, and appeals.

5. Coordinate defense of the claim with Department Attorneys and the Attorney General's Office. Prepare graphs, illustrations, tables and exhibits.

6. When indicated, attend examinations before trial, advise trial attorneys on engineering aspects of the evidence, and assists in formulating questions for the witnesses.

7. Perform independent estimates and evaluations of claimed costs and assists auditors.

8. Engage and confer with expert witnesses and outside consultants when necessary.

9. Assist the Department in the evaluation of construction claims and matters regarding alleged design errors, utility interferences, extra work, and time delays.

10. Note trends in claims and make recommendations for revisions of contract specifications and Department Policies and Procedures.

11. Work cooperatively with Department Attorneys on a wide variety of Department business matters and cases in support of a team approach.

12. Review and provide comments on behalf of the Claims Bureau for Department Clearance Reviews.

13. Assist in the management of the Department's Accident Damage Recovery Program.

Responsibilities may include serving a role within the Incident Command System to support the department’s response to regional and statewide emergency situations.
