Minimum Qualifications Law degree from accredited law school; admission to the NYS BAR in good standing; possess minimum 4 years of relevant post-BAR experience.

Duties Description Reporting to the Deputy Counsel for Licensing, Regulations and Compliance, the Associate Counsel for Compliance will serve in the Office of Cannabis Management’s (OCM) Office of General Counsel (OGC) and will be the primary attorney responsible for managing the compliance portion of the legal portfolio. The Associate Counsel for Compliance will provide legal counsel to the Division of Compliance, and will supervise all compliance matters, from initial statement of findings through administrative hearings and any appeals.

The Associate Counsel will be responsible for supervising attorneys and legal assistants within OGC in furtherance of these responsibilities. Other duties may be assigned as appropriate. The Associate Counsel will also be expected to attend meetings as needed, communicate well internally and externally, and be comfortable in the evolving field of Cannabis Law.


Duties include, but are not limited to:
• Work in conjunction with attorneys, paralegals, and administration to create a framework and streamline administrative processes.
• Work with Compliance staff to fine-tune auditing or investigative strategies to uncover violations of applicable laws or regulations.
• Represent OCM in administrative hearings concerning compliance matters, including reviewing and assisting with the drafting of statements of charges, Compliance Action Plans (CAPs), Statement of Charges, issuing subpoenas, drafting briefs, and representing OCM in any administrative hearings, or in any appeals.
• Train Senior Attorneys or Assistant Counsels, as needed, to represent OCM in administrative disciplinary hearings involving the failure of licensees to comply with the Cannabis Law and related regulations, .
• Conduct legal research and prepare legal memoranda with opinions, citations, and legal precedents in support of OCM and Cannabis Control Board (CCB) programs.
• Provide legal counsel, advice, and strategies in support of OCM and CCB.
• Respond to requests arising from interaction with the public, including reviewing and developing FAQ’s and other guidance affecting licensees and related stakeholders.
• Drafting formal and informal comments on compliance and enforcement legislation affecting OCM.
• Recommend revisions to existing laws and regulations affecting compliance matters in particular.
• Assist as necessary with preparation and finalization of rules and regulations in support of OCM’s and CCB’s business units, including processing in accordance with the State Administrative Procedure Act.
• Full range of supervisory function and responsibility, including reviewing/approving timecards, conducting performance reviews, and providing guidance and mentorship to subordinate staff.
• Other duties as assigned by the General Counsel or the First Deputy General Counsel.
