Provisional:
One Year of permanent competitive service as an HR Specialist 1 LR.

Duties Description Under the direction and guidance of senior level Labor Relations staff, the candidate for this position will:

Advise managers and staff in the application of all applicable CBA provisions, agency and state policies and procedures, and any labor relation applicable laws or rules that govern or impact agency staff.

Become proficient in labor relations procedures including but not limited to discipline, grievances, counseling guidance, workplace violence prevention, OTETA, EHS, and ADID processes.

Make recommendations to managers regarding counseling and progressive discipline.

Administer and implement all aspects of the grievance process including conducting Agency level/Step 2 meetings with grievants, union representatives, and program management.

First and second chair in representing the agency at grievance meetings and hearings, full and expedited disciplinary arbitration hearings, and unemployment insurance hearings.

Create and contribute to clear, accurate and comprehensive written: grievance decisions; draft investigative summaries; arbitration opening statements; arbitration closing arguments; agency policy; Notices of Discipline; Notices of Suspension; Stipulations of Settlement; and all communications set forth by Labor Relations.

Professionally participate in and conduct in person and remote: training presentations; witness preparations; staff interviews; disciplinary interrogations; and negotiations when applicable.


Participate in statewide Labor/Management Committee meetings.

Confer with the Governor's Office of Employee Relations and other control agencies as needed.

Provide direct and indirect supervision of a Labor Relations staff when applicable.

Day and overnight travel when necessary and sometimes with very short notice (10%).

Communicate effectively with all program areas within NYSDEC regarding LR actions.

Effectively work with while adequately providing notice and guidance to appropriate staff to properly effectuate Labor Relations work.

Perform Labor Relations work on behalf of and in the best interest of NYSDEC as a whole.

Consistently represent Labor Relations in a professional manner and demonstrate behavior and performance that sets a positive example for others. Complete other duties and special projects as assigned.


Additional Comments Must have a valid driver’s license or demonstrate the ability to meet the transportation needs of the position. Travel may be required. Overtime may be required. Overnight travel may be required. Telecommuting may be available, will be discussed at interview.
