Duties Description The New York State Office of Cannabis Management (OCM) is responsible for the regulation, licensure, and public health and safety of all cannabis and hemp operations in the state, as well as programmatic cannabusiness development. OCM leads the nation in its practice of centering equity and diversity in the opportunity of cannabusiness in communities statewide.

The Office of Administrative Hearings (OAH) is OCM’s administrative law body, separate from the OCM’s Office of General Counsel. OAH conducts hearings on cannabusiness licensure, compliance, and enforcement actions, among other matters.

The Chief Administrative Law Judge (CALJ)/Deputy Director reports to OCM’s Executive Director. The CALJ:
• Oversees and provides executive direction to OAH.
• Organizes and structures OAH’s hearings practice.
• Establishes procedural standards and consistency.
• Presides over evidentiary hearings and pre-hearing conferences.
• Identifies training and development opportunities for OAH administrative law judges.
• Must be a seasoned professional with both legal and executive experience with a proven record of leading and managing teams, providing legal advice on a administrative law matters, promoting and protecting agency mission, delegating and supervising complex tasks, and liaising with internal and external stakeholders.

The CALJ supervises the work of OAH’s supervising attorney and administrative law judges, giving guidance, direction, and support. When needed, the CALJ identifies and develops statutory, regulatory and/or operational changes to the processing and adjudication of administrative matters. The CALJ must ensure that OAH operations are accessible, consistent, transparent, and, in keeping with OCM’s mission, equity focused.

Duties include, but are not limited to:
• Upholding the agency’s mission and safeguarding the integrity of the hearings process.
• Overseeing the hearings process to ensure all parties receive impartial hearings and decisions timely.
• Overseeing daily hearings operations, including the assignment of hearings to adjudicators, handling daily issues that may emerge with respondents.
• Reviewing and updating current rules, protocols, and procedures for OAH operations, and propose changes when needed.
• Advising the OCM Executive Director on administrative hearing-related issues.
• Manage all OAH staff.
• Recruit and train administrative law judges; and
• Handle special assignments and projects as needed.

Minimum Qualifications Candidates must be admitted to the New York State Bar, currently in good standing, and have eight years of post-Bar legal experience.

Relevant experience includes, but is not limited to:
• Judicial practice (e.g., litigation, clerkship, judgeship), appeals, arbitration or mediation, administrative law, or regulatory litigation.

Preferred Qualifications:
• Three years’ experience supervising other attorneys or working in an administrative, managerial, or executive capacity.
• Excellent writing, communication, inter-personal, analytical, research, problem-solving, multi-tasking, and organizational skills.
• Ability to maintain and handle confidential documents and information.
• Ability to work strategically and collaboratively.
• Ability to communicate highly complex information clearly and succinctly, both orally and in writing.
• Ability to work under intense pressure and meet restrictive deadlines.
