Duties Description This position is in the Department of Health’s Division of Legal Affairs’ Bureau of Program Counsel, in Albany, New York.

Reporting to the Director of the Bureau of Program Counsel within the Division of Legal Affairs, the Associate Counsel will function as Deputy Director for the Bureau and will be responsible for assisting with supervision of the Bureau’s Public Health Group. Duties include:

- Supervising staff attorneys and support staff within the Public Health Group;
- Responding to on-going requests for legal opinions pertaining to public health and healthcare entities;
- Providing legal and technical assistance for the development of regulations and legislation;
- Reviewing proposed contracts and memoranda of understanding in which the Department of Health is a party;
- Providing consultation and advice to the General Counsel, Executive Staff, and Governor’s Office regarding policies that have legal implications; and
- Ensuring the professional development of new attorneys.

The Bureau handles a high volume of legal matters. During those times when circumstances require the Bureau Director to devote more attention to other legal matters, the Deputy Director will take an increased supervisory role with respect to the Public Health Group, maintaining appropriate consultation with the Director.

Minimum Qualifications Candidates must have been admitted to the New York State Bar and must have had four years of experience in the practice of law subsequent to admission to the Bar.

Preferred Qualifications: Supervisory experience. Experience with statutory and regulatory framework in which the NYS Department of Health operates. Knowledge of and experience in NYS’s budgetary, legislative, and regulatory processes. Skilled at negotiation. Experience with tight timelines and quick turnaround expectations.

Additional Comments For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.
