Minimum Qualifications Ten (10) years of criminal defense and/or parental appellate practice OR at least five (5) years of this experience if it includes supervisory experience.

Duties Description Assistant Counsel will be responsible for fulfilling the Office's responsibility to "make efforts to improve the quality of services provided pursuant to article 18-B of the county law*, Executive Law Article 30 Section 832 (1), with respect to the representation at the appellate and post-conviction levels of criminal defendants and parents who are represented by assigned counsel. The holder of this position will serve as the Director of Quality Enhancement, Appellate and Post-Conviction Representation and will report to the Director of the Office of Indigent Legal Services (ILS).
Responsibilities will include, but not be limited to:
• All case-related information and knowledge obtained in the performance of these duties will be treated as confidential information.
• Examines, evaluates and monitors the legal services provided statewide at the appellate and post-conviction levels pursuant to article 18-B of the County Law.
• Collects and analyzes data concerning such services and makes recommendations to the Director to enhance the provision of indigent legal services and to ensure that recipients of services are provided with quality representation from fiscally responsible providers.
• Makes recommendations to the Director to establish and implement standards, criteria and a process for qualifying and re-qualifying attorneys to provide effective appellate and post-conviction level representation.
• Makes recommendations to the Director for the provision of legal services in cases involving a conflict of interest.
• Makes recommendations to the Director for improving the delivery of legal services at the appellate and post-conviction levels.
• Encourages and supports the innovative and cost effective solutions that enhance the provision of quality indigent legal services, including collaborative efforts serving multiple counties.
• As directed by the Director of the Office, investigates and monitors any matter related to indigent legal services.
• Recommends measures of performance which programs and counties shall report to the Office for the purpose of monitoring the quality of indigent legal services.
• Undertakes such other activities as may be requested by the Director in furtherance of the Office's overall responsibility to make efforts to improve the quality of indigent legal services representation.
