Duties Description The Assistant Counsel will assist in the implementation of the reforms specified in Executive Law § 832 (4) for the development and implementation of written plans to (1) ensure that criminal defendants eligible for publicly funded legal representation are provided in person representation at his or her arraignment; (2) establish numerical caseload/workload standards for each provider of legally mandated publicly funded representation in criminal cases for persons unable to afford to counsel; and (3) improve the quality of legally mandated publicly funded representation in criminal cases for persons unable to afford counsel. The holder of this position will serve as Statewide Implementation Attorney – Caseload Standards and will report to the Statewide Chief Implementation Attorney, who works under the guidance of the Director of the Office of Indigent Legal Services (“Director”) and agency Counsel (“Counsel”). The holder of this position will be primarily responsible for assisting in the development and implementation of caseload/workload standards for each provider of constitutionally mandated publicly funded representation in criminal cases as specified in Executive Law § 832 (4)(b). The holder of this position will work closely with other staff in the Statewide Implementation Unit to fulfill the Office’s new statutory duties and responsibilities and improve the quality of mandated representation under article 18-B of the County Law. All case-related information and knowledge obtained in the performance of these duties is highly confidential and may be subject to the attorney-client privilege.
Specific responsibilities include:
• Evaluates and monitors the caseload/workloads of attorneys, including private practice attorneys, who provide mandated representation in New York City (“City”) and counties in New York State (other than the five counties names in the Hurrell-Harring settlement agreement) (”counties”), pursuant to Article 18-B of the County Law.
• Assists in the development of a written plan, in accordance with the provisions of Executive Law § 832 (4)(b), to establish numerical caseload/workload standards for each provider of constitutionally mandated publicly funded representation in criminal cases for people unable to afford counsel
• Assists in the development of caseload/workload standards in criminal cases for each provider of mandated representation in the City and counties, including representation in both trial- and appellate-level cases.
• Consults with the providers of indigent legal representation, county and City officials, judges and other interested entities to identify opportunities for implementing the caseload/workload standards developed by the Office.
• Monitors the progress of counties towards implementing the caseload/workload standards developed by the Office, including developing regular, periodic reports of such progress in accordance with the provisions of Executive Law § 832 (4)(b)(iv).
• Makes recommendations to the Statewide Chief Implementation Attorney for improving and reporting of progress made by the counties and City, including improving the overall quality of indigent legal services in a cost-effective manner and creating innovative systems for assessing the adequacy of caseload/workload standards.
• Undertakes such other activities as may be requested by the Director and Counsel in furtherance of the Office’s overall responsibility to make efforts to improve the quality of indigent legal services representation under article 18-B.
