Minimum Qualifications Six years of experience in the field of contract compliance, human rights, affirmative action, or minority, women-owned, or service-disabled veteran-owned business enterprise, including: planning, developing, implementing, and reviewing programs dealing with minority, women-owned, or service-disabled veteran-owned business enterprise, human rights, affirmative action, minority business program coordination, affirmative action compliance review, or labor relations directly relating to affirmative action; or experience in the development and administration of programs designed to facilitate minority community access to employment or business opportunities in the public or private sector.

Substitution: An associate’s degree in in business, marketing, economics, public administration may substitute for two years of experience. A bachelor’s degree in business, marketing, economics, public administration, or public policy may substitute for four years of the experience. A master’s degree in business, marketing, economics, public administration, or public policy may substitute for an additional one year of experience.

Duties Description Reporting to a Minority Business Specialist 2, G-23, in the Bureau of Contract Management, the Minority Business Specialist 1 will be responsible for compliance with the provisions of Article 15-A and Article 17-B of the Executive Law and the rules and regulations contained within 5 NYCRR Parts 140-144 and 9 CRR-NY Part 252, to ensure that Minority and Women Owned Business Enterprises (MWBEs) and Service-Disabled Veteran-Owned-Business (SDVOBs) are given maximum practical opportunities to participate in the Office of Temporary and Disability Assistance’s (OTDA) procurements. Duties of the position will include, but are not limited to, the following:

• Assist Program staff in ensuring providers comply with all provisions of law and the rules and regulations pursuant to the State’s MWBE and SDVOB programs.

• Work with OTDA Contract Management staff on procurements and discretionary purchases to identify potential MWBEs and SDVOBs that may participate in solicitations.

• Assist contractors and grantees in developing best practices to achieve the goals being set under a resulting contract/grant. Communicate with contractors/grantees throughout the contract process to ensure contract compliance with the MWBE and SDVOB goals.

• Assist with the development of partial or full MWBE waivers as applicable. Including review and certification of supporting “good faith efforts” documentation to achieve MWBE participation goals set forth in the solicitation or contract/grant.

• Review budgets and MWBE utilization plans submitted in response to solicitations and work with potential contractors/providers to assure understanding of the requirements under Article 15-A of the NYS Executive Law. Reconcile, release, and approve MWBE utilization plans submitted in the Statewide Utilization Management Plan (SUMP).

• Utilize the New York State Contract System to track monitor MWBE Compliance. Notify the Program Manager of MWBE/SDVOB Program Management Unit of any compliance issues that may require additional input or consideration.

• Assist with compiling quarterly MWBE participation data for OTDA’s contracts in the New York State Contract System (NYSCS) maintained by Empire State Development (ESD).

• Data collection and reconciliation for ad-hoc reporting request from regulatory authorities. Participate as necessary in the collection of data and reporting related to ESD’s diversity studies. Assist with data collection and processing of OTDA’s MWBE and SDVOB Master Goal Plans to ESD and Division of Service-Disabled Veterans' Business Development.

• Maintain MWBE/SDVOB policy documents and facilitate updates to OTDA’s internal Intranet and public Internet sites.

• Participate in bi-weekly MWBE status meetings.

• Coordinate and participate in training and various outreach opportunities offered by ESD and the Division of Service-Disabled Veterans' Business Development in relation to the MWBE program and future initiatives.

Additional Comments A full time, contingent permanent, non-competitive appointment will be made. If certified by Civil Service, mandatory reemployment list candidates must be considered first for appointment to this title.
