Minimum Qualifications The ideal candidate will have litigation experience; knowledge of major state and federal wage and hour laws; superior writing, editing, organizational and interpersonal skills; and a demonstrated commitment to public service. Familiarity with communities of low-wage workers in New York State is a plus, as are foreign language skills. Three (3) years or more of litigation experience is required.

Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Office be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.

Duties Description The Labor Bureau of the New York State Office of the Attorney General (NYAG) is seeking an attorney to serve as an Assistant Attorney General (AAG) in the New York City office. The Labor Bureau has been nationally recognized for aggressively enforcing labor standards in low-wage industries. Specifically, the Labor Bureau brings civil and criminal prosecutions for violations of minimum wage, overtime, prevailing wage, and other critical labor laws. Recent enforcement actions have targeted wage theft in a variety of industries, including construction, fast food, home health care, and car washing, and retaliation targeting immigrant workers. The Bureau has taken on emerging areas, such as anticompetitive labor practices like non-compete agreements, and nationally, the Labor Bureau has been at the forefront of multi-state efforts to fight federal rollbacks of critical labor protections. The Labor Bureau also represents the New York State Department of Labor in its enforcement of state labor laws and handles that agency’s defensive litigation.

The AAG will manage their own investigations and cases, including formulating strategies, developing investigations, and handling litigation. The AAG will interview witnesses, analyze data and documents (including electronically-stored information), draft pleadings and legal briefs, argue motions, take depositions, and negotiate settlements. In addition, there may be opportunities to handle appellate litigation and criminal prosecutions, conduct community and intergovernmental outreach, and work on legislative proposals and reports.

Additional Comments OAG employees serve more than 19.85 million state residents through a wide variety of occupations. We offer a comprehensive New York State benefits package, including paid leave, health, dental, vision and retirement benefits, and family-friendly policies. As an employee of the OAG, you will join a team of dedicated individuals who work to serve the people of our State.

Salary to be determined commensurate with experience.

Candidates from diverse backgrounds are encouraged to apply. The Office of the Attorney General is an equal opportunity employer and is committed to workplace diversity.
