Minimum Qualifications • JD degree
• Minimum of five years of experience in labor and/or employment law.
• Experience working on systems of internal controls preferred.
Duties Description Reporting directly to the Commissioner, the Director of Compliance oversees and supervises several confidential functions within the Division including, but not limited to, Internal Controls, EEO, labor and employee relations, and insures compliance with federal, state and local regulatory requirements relating to the operations of the Division. The Director of Compliance:
• Provides strategic and/or confidential advice to the Commissioner and First Deputy Commissioner in the review of the Division’s operations to identify, minimize, or avoid litigation risk in areas including performance management, internal policies, and labor relations;
• Creates or revises, with approval of the Commissioner and First Deputy Commissioner, policies and procedures that address the Division’s operations and/or regulatory compliance;
• Conducts reviews of the Division’s operational units to identify areas for improvement and efficiency and reports findings to Commissioner;
• Reviews contracts with outside organizations or vendors;
• Meets regularly with the Commissioner and First Deputy Commissioner to apprise and advise of the status of operational issues, personnel and labor issues or complaints and to update on the status of reports and projects;
• Represents the Division on special taskforces and state-wide initiatives as directed by the Commissioner including Cyber Risk Management and Exploited Workers Taskforce.
• Labor Management
o Conducts the Division’s labor/employee relations program including the proper administration of negotiated contracts with bargaining units, administration of discipline and grievance procedures and managing dialogue with employee representatives including participation in Labor/Management, Workplace Violence and Health and Safety Committees;
o When necessary, represent the Agency in any arbitration or other legal proceeding related to an employee disciplinary action.
• Internal Control Officer
o Implements and reviews and evaluates the effectiveness of the internal control efforts of the Division;
o Works with appropriate Division personnel to coordinate internal control and information security protocols and activities;
o Ensures that the agency’s internal control program meets the requirements established in Division and state-wide policies;
o Prepares Annual Internal Control Certification report for the agency;
o Oversees the preparation and submission of all internal and external reports pertaining to internal controls, information security, and physical security/risk assessments.
• Equal Opportunity Officer
o Provides sound counsel to the Commissioner and First Deputy Commissioner on current and potential EEO issues;
o o Supports any investigation of alleged internal investigation conducted by GOER (Governor’s Office of Employee Relations);
o Makes recommendations to the Commissioner for corrective measures to address potential or recurring personnel or workplace issues.
• ADA Coordinator/Designee for Reasonable Accommodations
o Develops, implements and monitors policies and procedures in compliance with the Americans with Disabilities Act;
o Receives all requests for reasonable accommodation and engages in an interactive process with the employee to determine if the accommodation can or should be provided and in what form.
o Communicates with medical professionals, employee’s supervisors and Division finance director, as appropriate, to conduct analysis and business impact of accommodation and discuss alternatives where applicable.
• Other Projects
Works on any other projects or assignments as directed by the Commissioner.
Additional Comments Downstate employees receive an additional $3,026 in location pay annually.
