Minimum Qualifications Qualified candidates must possess a bachelor’s degree or higher in the Arts or Sciences – including, but not limited to environmental science, engineering, management, public policy - and progressively responsible experience in matters related to utility regulation and siting, including experience in a managerial role. Candidates will also possess knowledge of New York’s electric and gas industries, strong leadership skills, and strong verbal and written communication skills.
Duties Description The Director of Facility Certification & Compliance’s duties include but are not limited to:
• Managing and coordinating the work of the Facility Certification and Compliance sections, including, but not limited to, identifying common issues, working on policy matters, and ensuring management is apprised of emerging issues and progress on Office assignments.
• Managing and overseeing project certification including application completeness review, project impact analysis, interagency coordination, and testimony and brief preparation and defense for litigation or settlement for all electric generation projects and all electric and natural gas transmission projects considered under Article 10 and Article VII of the Public Service Law.
• Driving process improvements to smooth operations, manage resource constraints, and handle the high volume and quickening the pace of the work.
• Managing and overseeing review of utility projects submitted pursuant to 16 NYCRR Part 102.
• Managing field compliance work including pre-certification constructability review and construction oversight for all electric generation projects and all electric and natural gas transmission projects certified under Article 10 and Article VII of the Public Service Law.
• Managing and overseeing the utility vegetation management programs for all of the State’s electric and gas utilities, including field review, rate case requests, annual program reviews and investigation of violations.
• Leading the process of interfacing with utilities, the Department of Environmental Conservation, and federal reliability entities on vegetation management best practices and standards.
• Managing field compliance oversight during project construction, field audits, and site inspections to determine compliance with certification requirements.
• Completing and/or delegating various ad hoc assignments related to Facility Certification & Compliance, initiated by management.
Additional Comments The Department of Public Service is seeking a Director of Facility Certification & Compliance for its senior management team to oversee and lead the Facility Certification and Compliance sections, comprising 15 to 30 employees. Given the prominent role these sections play in the Department’s technical review of large-scale renewable electric generating facility siting in furtherance of the State’s Clean Energy Standard mandate of 50 percent renewable energy by 2030, the Director will serve as both an internal focal point to aid with organization and resources allocation within DPS and the public face of the siting processes. They will guide the office to promote balanced, clear, and effective processes to help ensure responsibly sited facilities that are consistent with State policy goals, provide benefits to communities, and are appropriately protective of the State’s natural environment.
The Facility Certification and Compliance sections monitor and coordinate the New York State environmental compliance, siting, and certification process for generation and electric and gas transmission facilities. The sections advise on local, State, and federal policies, legislative proposals, and ratemaking regarding environmental issues and oversee the development and implementation of a streamlined but thorough process, in cooperation with key stakeholders, to guide facility siting in the State. Additionally, the sections coordinate utility vegetation management activities and participates in, and conducts, SEQRA reviews.
Salary will be commensurate with experience. The primary location for this position is Albany. This is an appointment to a position in the exempt jurisdictional class. As such, the incumbent of this position would serve at the pleasure of the appointing authority.
