Minimum Qualifications

Interested candidates must be reachable on the open competitive Legal Specialties list or be eligible to transfer under Section 52.6 of the Civil Service Law and meet the special qualifications as listed below:


To be eligible for transfer under Section 52.6:

Candidates must have one year of permanent competitive service in a qualifying title allocated to

grade 23 or higher and must have 12 months as an Assistant Attorney 3 OR admission to the New York State Bar AND 24 months of subsequent satisfactory legal experience.

Duties Description Provide legal advice to Office of the State Comptroller and staff of the Division of Local Government and School Accountability (LGSA) in connection with audits of local governments and school districts, accounting releases and functions of the Comptroller related to Municipal government and finance, and provide advisory technical assistance to municipal attorneys, certain local government officials, taxpayers and others on various areas of municipal law, including municipal finance, procurement, ethics, real property taxes and assessments. Review and edit informational materials prepared by LGSA staff for posting on OSC website.

· Analyze documents and inquiries to identify legal issues.

· Perform necessary legal research of statutes, case law, legislative history, etc.

· Develop response, including legal rationale.









Provide legal advice to the Officer of the State Comptroller and LGSA and Bureau of Debt Management staff on matters relating to the approval of terms and conditions of local bond issuances.

· Identify legal issues.

· Research statutes, case law, etc., as necessary to resolve the issues.

· Develop response (written or oral, as the case may be), including legal rationale.

· Provide response to inquirer.

· Review disclosure documents.

Make presentations at training seminars, webinars and teleconferences for local officials and OSC staff on various areas of municipal law.

· Prepare and research the subject area, draft outline of written remarks, prepare handouts and PowerPoint, finalize and make presentation.


Draft OSC Program Bills and supporting memoranda. Comment on pending and 10-day bills pertaining to municipal finances

· Research and prepare proposed bill language and memoranda for review, as necessary.

· Review and analyze bills.

· Prepare and present comments.


Assess the legal sufficiency of applications by local governments for the State Comptroller’s approval of certain actions, including:

· The investment in notes issued by other local governments.

· Exceeding or excluding indebtedness from Constitutional debt limits.

· The establishment of town and county special districts (including water and sewer districts), and business improvement districts.

· The issuance of indebtedness by certain local governments located within the Adirondack Park.

o Undertake review and analysis of documents and information submitted as part of the application including resolutions, contracts and other materials.

o Apply legal principles of the law pertaining to the Comptroller’s approval functions.

o Coordinate with LGSA staff and interact with representatives of the applicant-local government.

o Draft in-house legal opinions, approval orders and other documents in connection with the approval function.

· Excellent legal research skills and ability to analyze legal issues, and identify significant rules, opinions and facts.

· Fundamental understanding of the structure and function of NYS local governments.

· Ability to organize large volumes of factual and legal data into clear and logical sequences.
