Minimum Qualifications Admission to NYS Bar and 24 months of subsequent satisfactory legal experience.

Preferred Qualifications: Experience with immigration law, governmental grant administration, and Freedom of Information Law (FOIL); strong written and verbal skills.

Duties Description The Senior Attorney will serve the Department of State as the program attorney for the Office for New Americans (ONA), and will also serve as backup FOIL Counsel for the Department.

As ONA Program counsel, the Senior Attorney will provide ONA with legal assistance and guidance on a variety of topics including immigration law and policy and grants administration. Tasks will include research and writing, document development and review, and staying up to date on changes to immigration laws and regulations. The attorney will work directly with ONA’s management and staff to stay updated on program activities and provide advice and assistance as needed.

As backup FOIL Counsel, the Senior Attorney will assist the Department’s FOIL Counsel and Records Access Officer to timely respond to FOIL requests and facilitate communication between the Department and the Executive Chamber pertaining to such requests and work closely with assigned program counsels to review information requests under FOIL, the Personal Privacy Protection Law and the Health Insurance Portability and Accountability Act (HIPAA). The Senior Attorney may also be assigned to other program areas or special projects as needed and at the discretion of the General Counsel.

Additional Comments The Department of State is a diverse agency consisting of approximately 500 employees working on more than 15 distinct programs throughout the State. The Department provides services to more than 1,500 municipalities on matters relating to local and regional planning, community revitalization, building and energy code enforcement, coastal management, waterfront revitalization and efforts to combat poverty, including efforts specifically focused on helping new immigrants attain success in New York State. The Department supports business, public safety and NY State citizens through the licensing of over 36 professional occupations, the registration of trademarks, the filings of certificates of incorporation, the keeping of vital records, and the protection of consumers. The Department also houses the Committee on Open Government, Authorities Budget Office and the NY State Athletic Commission.
