Minimum Qualifications Appointment Method:

This is an appointment to a position in the exempt jurisdictional class. As such, the incumbent of this position would serve at the pleasure of the appointing authority.

Duties Description The Department of Financial Services is seeking an attorney to work directly with the agency’s Executive Deputy Superintendent for the Cybersecurity Division and other top executive staff. The position will focus on all aspects of cybersecurity and privacy regulations.

Responsibilities will include policy and guidance for DFS’s cybersecurity regulations, and addressing cybersecurity and privacy issues arising from DFS’s supervision and examinations of the financial industry. Responsibilities will also include such tasks legal research, drafting memoranda of law and/or reports, regulatory guidance, and providing updates to the Superintendent and other senior staff. The Counsel will also assist with cybersecurity-related enforcement actions, where responsibilities could include such tasks as taking testimony, conducting witness interviews, and legal research. The Counsel will be expected to oversee the work of more junior attorneys and staff.

Preferred Qualifications:

Admission to the New York State Bar and at least three years in the practice of law involving one or more of the following:
• Regulatory compliance
• Investigations
• Enforcement
Experience with incident response, cybersecurity, and/or data privacy is preferred.

Additional Comments Please note that positions located within the New York City metropolitan area, as well as Suffolk, Nassau, Rockland, and Westchester Counties, are also eligible to receive an additional $3,026 annual downstate adjustment.

Appointment to this position is pending Division of Budget approval to fill.
