Minimum Qualifications Applicants must have a minimum of ten years of experience litigating complex environmental cases. The ideal candidate will have knowledge of federal and state environmental statutes; served as primary counsel in both federal and state court litigation, including cases brought under Article 78 of the New York Civil Practice Law and Rules; experience in every aspect of litigation, including initiation of litigation, discovery, motions, oral arguments, trials, and settlements; and at least three years of experience managing attorneys and litigation teams. Excellent writing skills are required, and the applicant must have the ability to work well with client agencies. A commitment to public service is essential.
Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Office be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.

Duties Description The Environmental Protection Bureau in the New York State Office of the Attorney General is seeking an experienced litigator to serve as Section Chief of the General Litigation Section. The General Litigation Section represents state agencies in both defensive and affirmative civil litigation in state and federal courts. The Section Chief is responsible for managing that litigation and supervising a group of attorneys with diverse experience and skills. This position is located in New York City.
Some of the more recent matters handled by the Section include an action against the New York State Department of Environmental Conservation claiming that a state prohibition on products containing ivory is preempted by federal law, an action against DEC challenging its decision to close an oyster cultivation area on Long Island based on high bacteria, and an enforcement action on behalf of the Long Island Pine Barrens Commission against an illegal development within the Pine Barrens.
