Minimum Qualifications Minimum Requirements:
Admission to NYS Bar and 24 months of subsequent satisfactory legal experience.
Preferred Qualifications:
• Knowledge of New York State open government laws and legislation;
• Experience developing and conducting training and outreach, and providing technical assistance, including:
o Making public presentations;
o Preparing complex reports and filing briefs or papers on New York’s open government law issues, including Freedom of Information, Open Meetings or Personal Privacy Protection Law;
• Strong research, writing and verbal skills; and
• Demonstrated commitment to public service
Duties Description The Committee on Open Government is housed within the Department of State, and is responsible for overseeing and advising with regard to the Freedom of Information Law (FOIL), the Personal Privacy Protection Law (PPPL), and the Open Meetings Law (OML) (Public Officers Law, Articles 6, 6-A, and 7, respectively). The Committee offers advice and guidance to the public, representatives of state and local government, and to members of the news media. Recommendations to improve open government laws are offered in an annual report to Governor and the State Legislature. The Committee also provides trainings and presentations to stakeholders state-wide throughout the year. The Committee may also promulgate regulations as authorized by law.
The Senior Attorney will provide professional legal support to the Committee on Open Government. Specific duties may include:
• Track and review proposed New York open government (FOIL, PPPL, OML) legislation and prepare summaries;
• Track New York State and nationwide open government decisional law and prepare case law summaries;
• Review FOIL and OML advisory opinions for consistency and significance;
• Answer questions and provide guidance regarding New York open government laws from the public, government agencies, and the media;
• Assist with the preparation of training modules relating to New York open government laws;
• Prepare legal advisory opinions concerning New York open government laws in consultation with a supervising attorney.
