Minimum Qualifications Appointment Method:

This is an appointment to a position in the non-competitive jurisdictional class. As such, the incumbent of this position would serve at the pleasure of the appointing authority. Candidates must meet the minimum qualifications listed below in order to be eligible for appointment.

Minimum Qualifications:

Non-Competitive: Admission to the New York State Bar and four years of legal experience subsequent to admission to the NYS Bar. Legal experience must be in one or more of the following fields: litigation or financial industry investigations; corporate law involving such actions as corporate mergers, dissolutions, stockholder meetings and other related corporate actions; commercial financial documentation and negotiation; bank regulatory experience; insurance regulatory and legislative experience; and prosecutorial experience gained in a city, state, or federal law enforcement or administrative agency that regularly conducts civil enforcement action in financial and commercial matters.

Substitutions

A master’s degree in law with a concentration in Banking Law, Insurance Law, Financial Services Law, Corporate Law, or international legal studies may substitute for two years of the experience.

Duties Description The Department of Financial Services (DFS) is expanding its virtual currency team and is looking for dynamic professionals to fill the position of Associate Attorney Financial Services in the Research & Innovation Division. DFS is seeking individuals with a variety of backgrounds and skill sets, for virtual currency application review and analysis; examination of regulated virtual currency firms; supervision of firms seeking to make changes to their business; and other tasks relevant to the sound regulation of this dynamic industry. Virtual currency experience is helpful but not required. Duties of this position may include, but not be limited to the following:

• Reviews and analyzes submissions from supervised virtual currency entities, including requests for approval of new products, new lines of business, planned M&A events, and other material changes in business, recommending action by the Department;
• Engages with outside entities, including virtual currency firms, law firms, and consultants, regarding submissions, examinations, and other matters;
• Participates in legal and/or policy discussions and analyses working with Office of the General Counsel in some cases;
• Participates in the analysis of documents submitted by or collected from virtual currency entities, through the examination process or otherwise;
• Advises colleagues on the virtual currency team on legal issues concerning licensing or supervision;
• Prepares briefing materials and memoranda for managers and senior executives, including memoranda making reasoned recommendations for Department action;
• May participate in examinations of virtual currency businesses, and/or review and analyze license/charter applications from virtual currency entities, and
• Works on ad hoc projects as required, often involving legal or policy considerations.

Additional Comments Please note that positions located within the New York City metropolitan area, as well as Suffolk, Nassau, Rockland, and Westchester Counties, are also eligible to receive an additional $3,026 annual downstate adjustment.
