Salary RangeFrom $110970 to $135089 Annually
Minimum Qualifications Law degree and five years of experience as an attorney in any combination of the following:
• In a governmental regulatory agency, analyzing applications and petitions for agency action, including areas such as analyzing legal issues, drafting orders, and researching and interpreting complex areas of regulatory law;
• Practicing in general administrative, energy or environmental law, analyzing legal issues, litigating agency cases, and researching and interpreting complex areas of regulatory law.
• Coordinating all hard rule making, including taking rulemaking products from the Notice of Proposed Rulemaking stage to final adoption stage;
• Providing legal advice on procurement and other contracts; and
• Providing legal advice related to the review and resolution of consumer appeals.
Must be admitted to the New York State Bar.
Duties Description The Assistant Counsel, NS=31, works in the Office of Special Counsel for Ratepayer Protection, and applies significant process and subject-matter expertise in furtherance of the Special Counsel’s mandate to represent the interests of residential and commercial customers of New York's regulated electric, gas, water, and telecommunication companies, with the ability to participate as a party in Public Service Commission proceedings, conduct hearings and investigations, undertake discovery to compel documents and testimony, and otherwise coordinate the resources of the Department of Public Service to safeguard the interests of ratepayers and hold accountable those utilities and telecommunication companies which fail to meet their contractual and regulatory obligations to their customers.
Reporting directly to and working under the direction of the Special Counsel for Ratepayer Protection, duties include, but are not limited to:
• Analyzing applications and petitions for Public Service Commission (Commission) action on utility requests for rate increases, tariff changes, and other matters.
• Working effectively with colleagues across offices to best deliver on the mission of the Department and the Office of Special Counsel.
• Researching and interpreting complex areas of regulatory law, Commission decisions, and economic policies.
• Preparing memoranda on legal issues related to actions of the Commission.
• Assisting in investigations of regulated entities where the Special Counsel is involved.
• Drafting litigation documents, including orders to show cause, document demands, interrogatories, and subpoenas, in both regulatory and court proceedings.
• Conducting depositions, and direct and cross examinations of witnesses.
• Drafting orders and other documents to effectuate Commission decisions.
• Leading staff preparation and presentations in Commission proceedings set for hearings, negotiations, and alternative dispute resolution.
• Representing the Special Counsel in settlement discussions.
• Coordinating staff teams (accountants, engineers, economists, and other experts) and assisting in the development of issues in cases.
• Assisting the public in understanding and being involved in Commission processes.
• Providing advice to the Commission on behalf of the Special Counsel.
Additional Comments Salary will be commensurate with experience. The primary location for this position will be in either Albany, New York City, or Plainview, NY with up to 10% travel. Additional travel may be needed depending on assignments and locations. This is an appointment to a position in the exempt jurisdictional class. As such, the incumbent of this position would serve at the pleasure of the appointing authority. Appointment to this position is contingent upon Division of Budget approval.
