Duties Description Under the general direction of an Associate Attorney within the Office of General Services (“OGS”), the Senior Attorney will provide legal assistance to support various agency functions including the management and disposition of State real property, the leasing of private property for State purposes, and other legal matters and special projects. Typical duties include, but are not limited to:

1. Assists in the management and disposition of State land and buildings by providing legal support to real property staff regarding applications and contracts for the acquisition, reuse, conveyance, lease, or exchange of properties deemed surplus to agency program purposes.

2. Advises and consults with prospective purchasers of State land regarding the legal requirements required for the transfer and conveyance thereof, including the review and interpretation of applicable law and regulation such as the Public Lands Law, Real Property Law, Public Authorities Law, and Environmental Conservation Law and the preparation of associated real property conveyance documents including contracts, deeds, easements, leases, transfers of jurisdiction, orders, releases, and permits.

3. Assists with the negotiation, drafting, and review of (i) leases and permits with private entities for occupancy by State agencies and (ii) leases and permits for the use of State retail property by private tenants.

4. Consults with and secures approval, when necessary, of the State’s control agencies, including the Office of the Attorney General and the Office of the State Comptroller for a wide variety of OGS real property and support services transactions. Assures compliance with procurement lobbying and vendor responsibility guidelines of the Office of the State Comptroller.

5. Furnishes, through an Associate Attorney, to OGS senior staff, professional evaluation, legal research, and advice relating to the disposition of the State’s real estate portfolio of buildings, program lands, and leased space and the use and regulation of the State’s navigable waters.

6. Coordinates with the Real Estate Planning and Development for the appraisal, survey, and inspection of real property when required, including environmental impact review. Provides legal advice to program as needed.

7. Represents and participates, with an Associate Attorney and senior staff, in internal and external conferences and meetings involving State real property issues with State agencies, local governments, and private sector entities. Such representation and participation may vary in length and degree of formality but shall require a thorough preparation and skilled assessments supported by research.

8. Where necessary, assists senior staff and Office of the Attorney General in the evaluation of and response to real property claims against the State or OGS and the development of appropriate defenses to such claims.

9. Provides legal support and counsel on real property, support services, and general legal issues affecting agency administration, including the drafting of legal opinions and memoranda as assigned by the Counsel, senior legal staff, and business unit administrators.

10. When requested to do so by the Deputy Counsel or the Counsel, assists the real property and support services programs in the preparation and review of OGS legislative proposals and State agency legislative proposals relating to the State’s real estate portfolio and support services program.

Performs other duties as assigned by the Counsel, the Deputy Counsel, the Supervising Attorneys, or the Associate Attorneys.
