Minimum Qualifications Candidates must have a law degree from an accredited law school and admission to, and be a member in good standing of, the New York State Bar and should have four years of experience in the practice of law subsequent to their admission to the Bar.

Preferred Qualifications: Prior experience working with not-for-profit organizations and/or relevant federal and state tax laws and regulations affecting such organizations.

Duties Description Reporting to the General Counsel, the incumbent will perform and supervise legal analysis and interpretation of laws related to the requirement of designated charitable organizations to file annual financial reports with the Department of State (DOS). As a new function within DOS, legal staff will be engaged in activities with a high complexity of new and evolving laws and regulations governing these required filings, with legal and regulatory responsibilities, and with a strong role in decision making.

Specific duties include:

• Direct and oversee the examination of Annual Financial Reports to determine whether a 501(c)(3)’s support to other entities or a 501(c)(4)’s spending on covered communications is inconsistent with its charitable purpose and to make the determination if public disclosure of a report may cause harm to the source of donation.

• Prepare and present DOS’s position, arguments, and cases at judicial, quasi-judicial, and administrative proceedings or article 78 appeals.

• Discuss proposed legislation with other state agency management, legislators, and legal staff and advise them concerning legislation that affects annual financial reporting and prepare drafts of proposed legislation.

• Recommend changes in rules, regulation, and policy statements, taking into account new legislation, court decisions, and requests for changes.

• Provide legal advice and opinions, complainants, and others in connection with the requirement that certain non-profit organizations file financial and funding disclosure reports with DOS.

• Negotiate and prepare legal documents.

• Prepare legal actions to enforce laws, rules, and regulations.
