Minimum Qualifications Qualified candidates must possess a Law Degree in addition to being a member in good standing of the New York State Bar.

Preferred Qualifications

Broad array of environmental/regulatory law experience, including experience with administrative hearings or litigation, analyzing legal issues, and researching and interpreting complex areas of law; experience in the energy and environmental sectors, and more specifically with New York’s electric industry and/or renewable energy field, clean energy siting, or in siting of major transmission and/or generation projects under the State Environmental Quality Review Act, Public Service Law (PSL) Article VII and/or PSL Article 10; and strong oral and written communication skills.

Duties Description Reporting to the Executive Deputy Director, the Hearing Examiner will serve as Chief Administrative Law Judge and conduct, or manage Hearing Officers who conduct, quasi-judicial or administrative hearings and who are also responsible for the factual and legal review of applications for siting permits under section 94-c of the Executive Law and other statutes administered by the Office of Renewable Energy Siting (ORES). The incumbent will perform duties that include, but are not limited to, the following:

• Supervise assigned Hearing Officers and trainees and provide guidance and training.
• Review and monitor draft decisions of assigned Hearing Officers and trainees, assist Hearing Officers and trainees with hearings including observing hearings, when needed. Assist in drafting decisions and with difficult or challenging issues presented by parties and/or their representatives.
• Keep current on rules and regulations, changes in law, administrative directives, etc., and require that each assigned Hearing Officer and trainee keep current as well.
• Advise assigned Hearing Officers and trainees of amendments or changes in regulations. Consult with assigned Hearing Officers and trainees with respect to hearings, Department policies, rules and regulations.
• Monitor and evaluate assigned staff’s work production and quality, and, take the appropriate measures if performance standards are not met. Elicit suggestions for ways and means to improve performance and, by conduct and professionalism, serve as an example to the assigned Hearing Officers or trainees.
• Monitor the backlogs of assigned staff to ensure that the Hearing Officers remain current and in compliance with the requirements of various court orders concerning time limits placed on how long is acceptable from the date the hearing is requested to the date of issuance.
• Assist Hearing Officers and Trainees in the conduct of hearings, including drafting and issuing decisions as needed.
• Manage the Intervenor Funding process, communicate between Local Agencies/Potential Community Intervenors.
• Manage the Public Hearing process, and preside over the Adjudicatory Hearing process.
• Other tasks as assigned.

Additional Comments ORES will be instrumental in helping New York State meet the Climate Leadership and Community Protection Act (CLCPA) policy goals, the most ambitious climate legislation in the United States. The office will be responsible for implementing and executing a new streamlined permitting process for renewable energy projects in New York State greater than 25 MW, and any projects 20 MW and above that opt into the siting process administered by ORES. The process has been streamlined within this new office to decrease the time from application to approval for construction to a maximum of one year.
