Minimum Qualifications Qualifications for the position of Assistant Attorney General are as follows:
• A minimum of five (5) years of legal experience with significant litigation experience in New York State Courts;
• Ability to handle all phases of litigation including discovery, depositions, motion practice, trials, and judgment enforcement;
• Superior skills in legal analysis and writing; and
• Prior bankruptcy experience is desirable.
Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Office be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.
Duties Description The New York State Office of the Attorney General is seeking an attorney to serve in the General Recoveries Unit of the Civil Recoveries Bureau, in Albany, to represent The Lawyers’ Fund for Client Protection of the State of New York. The Lawyers’ Fund reimburses victims of dishonest conduct by attorneys in the practice of law. The primary responsibility of this position is to prosecute civil litigation against dishonest attorneys to recover the restitution monies paid by The Lawyers’ Fund to their victims. Such litigation includes: claims against banks for honoring forged indorsements or negligently administering attorney escrow accounts, recovery against the dishonest attorney, their law firm and partners, and recovering property fraudulently conveyed by the dishonest attorney. The position also requires the commencement of special proceedings for the turnover of funds held in the escrow accounts of deceased attorneys, as well as actions to recover funds based on the subrogation of claims by the reimbursed party. The Lawyer’s Fund Assistant Attorney General must also defend Article 78 proceedings brought by individuals whose claims for restitution were denied. Cases often involve ancillary areas of the law such as real property, bankruptcy, and Surrogate’s Court practice.
