Minimum Qualifications Admission to the New York State bar and four years of experience in the practice of law subsequent to admission to the Bar.

Preferred Qualifications:

Candidates must possess a JD from an accredited law school and a license to practice law in New York State and have:
• At least four years of litigation experience, at least one of which has been in a supervisory role;
• Must be highly proficient with document reviews, productions, ESI, and trial preparation, including at least two years of experience using an eDiscovery software solution such as Relativity, LAW, Concordance, Summation, Catalyst or similar;
• Excellent written and verbal communication skills;
• Outstanding time management skills and ability to prioritize shifting responsibilities;
• Critical thinking skills and the ability to retain complex work directions.

Preferred Experience:

• At least one year of experience using Office 365 including the Office 365 eDiscovery Center or Search & Compliance Center.

Duties Description The NYS Office of Information Technology Services (ITS) was created in the fall of 2012 to provide consolidated and consistent information technology (IT) to NYS agencies and to effect consistent and cutting edge technology policy across NYS agencies. ITS is seeking an experienced attorney to serve as Enterprise eDiscovery Counsel and Director of Litigation in ITS’s Counsel’s Office.

The Enterprise eDiscovery Counsel, under the direction of the General Counsel, will provide ITS, including its program areas, project teams, Portfolios, and executive management, with legal and policy-related advice concerning data management and litigation issues. This includes providing policy and legal advice, support, and guidance related to the direction, implementation, and maintenance of major technology initiatives involving data management. The Enterprise eDiscovery Counsel will also take an active part in ensuring that ITS is compliant with the laws, rules, and regulations that impact the agency’s operations.

More specifically, under the supervision of the General Counsel the Enterprise eDiscovery Counsel and Director of Litigation duties include but are not limited to:

• Advise executive agency counsel and the Office of the Attorney General on eDiscovery and other IT issues impacting litigation and adversarial matters statewide;

• Oversee and manage IT and legal staff dedicated to technical and legal support of the State’s Office365 eDiscovery/Compliance Center toolsets and program;

• With the assistance of the IT manager of the Enterprise eDiscovery Services Team, develop policies for, oversee and manage the State’s Office365 eDiscovery program at ITS, including oversight and management of eDiscovery Compliance Centers for all executive agencies;

• With support from Enterprise eDiscovery Services Team IT staff, provide training and legal support for all executive agency eDiscovery Compliance Officers;

• Manage the ITS eDiscovery matters portfolio;

• With respect to electronic discovery or data management matters, coordinate, liaise and manage ITS relationship with Attorney General’s Office and NYS Inspector General; and

• Support the General Counsel and the Supervising Attorney with oversight and administration of the Counsel’s Office as needed,
