Minimum Qualifications The position of Assistant Counsel is in the exempt Jurisdictional Classification and as such, the incumbent serves at the pleasure of the Governor. For this particular position, based on the duties the incumbent is expected to perform, we require the following minimum qualifications:

Candidates must be admitted to the NYS Bar and have two years of subsequent legal experience. Legal experience should include analyzing complex legal issues; preparing briefs; researching statutes, opinions, etc.; reviewing contracts, agreements, legislation, and other legal documents; preparing and presenting arguments before judicial, quasi-judicial, or legislative bodies; and providing legal advice to high-level mangers.

Duties Description The incumbent will work within the Office of Legal Services under the Division of Legal Affairs (DLA), focusing upon Construction, Contract, and Freedom of Information Law (FOIL) matters.

NYSDOT lets and administers over 200 construction contracts a year, totaling over $1.5 billion. Nearly every construction contract requires DLA attention at some point, including on issues of MWBE/DBE attainment, right of way acquisition, project labor agreement, vendor responsibility, environmental concerns, and contract disputes and claims. The Assistant Counsel will coordinate with the Offices of Construction, Civil Rights, Environment, Contract Management, and Right of Way to ensure construction contracts are properly and timely drafted, procured, and awarded. Post-letting, the Assistant Counsel will help respond to issues stemming from contract administration, torts arising from projects, and construction disputes and claims.

The Assistant Counsel will also work with the Office of Contract Management, which oversees over $3 billion of procurements annually. In addition to construction contracts, the Assistant Counsel will work on architectural, engineering, and surveying contracts, numerous consultant contracts, and a wide variety of local, modal, and intergovernmental contracts. This work includes drafting and review of solicitations, answering questions from bidders, and analysis of the proposal and procurement process.

Responsibilities may include serving a role within the Incident Command System to support the Department’s response to regional and statewide emergency situations.
